| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. The heading to Chapter 55, Occupations Code, is |
|---|
| 10 | 10 | | amended to read as follows: |
|---|
| 11 | 11 | | CHAPTER 55. LICENSING OF [RENEWAL OF LICENSE WHILE ON] MILITARY |
|---|
| 12 | 12 | | MEMBER OR MILITARY SPOUSE [DUTY] |
|---|
| 13 | 13 | | SECTION 2. Chapter 55, Occupations Code, is amended by |
|---|
| 14 | 14 | | adding Section 55.004 to read as follows: |
|---|
| 15 | 15 | | Sec. 55.004. TEMPORARY LICENSE. (a) In this section, |
|---|
| 16 | 16 | | "military" means the armed forces of the United States. |
|---|
| 17 | 17 | | (b) A state agency that issues a license shall adopt rules |
|---|
| 18 | 18 | | for the expedited issuance of a temporary license to an applicant |
|---|
| 19 | 19 | | who: |
|---|
| 20 | 20 | | (1) is serving on active duty as a member of the |
|---|
| 21 | 21 | | military; |
|---|
| 22 | 22 | | (2) was honorably discharged from active duty as a |
|---|
| 23 | 23 | | member of the military not more than one year before the date of the |
|---|
| 24 | 24 | | application; or |
|---|
| 25 | 25 | | (3) is the spouse of a person who is serving on active |
|---|
| 26 | 26 | | duty as a member of the military. |
|---|
| 27 | 27 | | (c) The state agency shall issue the temporary license under |
|---|
| 28 | 28 | | this section to a qualified applicant who: |
|---|
| 29 | 29 | | (1) submits an application on a form prescribed by the |
|---|
| 30 | 30 | | agency; and |
|---|
| 31 | 31 | | (2) pays the required fees. |
|---|
| 32 | 32 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 33 | 33 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 34 | 34 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 35 | 35 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 36 | 36 | | Act takes effect September 1, 2009. |
