55 AN ACT
66 relating to the temporary occupational licensing of members of the
77 military and their spouses.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. The heading to Chapter 55, Occupations Code, is
1010 amended to read as follows:
1111 CHAPTER 55. LICENSING OF [RENEWAL OF LICENSE WHILE ON] MILITARY
1212 MEMBER OR MILITARY SPOUSE [DUTY]
1313 SECTION 2. Chapter 55, Occupations Code, is amended by
1414 adding Section 55.004 to read as follows:
1515 Sec. 55.004. TEMPORARY LICENSE. (a) In this section,
1616 "military" means the armed forces of the United States.
1717 (b) A state agency that issues a license shall adopt rules
1818 for the expedited issuance of a temporary license to an applicant
1919 who:
2020 (1) is serving on active duty as a member of the
2121 military;
2222 (2) was honorably discharged from active duty as a
2323 member of the military not more than one year before the date of the
2424 application; or
2525 (3) is the spouse of a person who is serving on active
2626 duty as a member of the military.
2727 (c) The state agency shall issue the temporary license under
2828 this section to a qualified applicant who:
2929 (1) submits an application on a form prescribed by the
3030 agency; and
3131 (2) pays the required fees.
3232 SECTION 3. This Act takes effect immediately if it receives
3333 a vote of two-thirds of all the members elected to each house, as
3434 provided by Section 39, Article III, Texas Constitution. If this
3535 Act does not receive the vote necessary for immediate effect, this
3636 Act takes effect September 1, 2009.
