55 AN ACT
66 relating to the regulation of investigations companies and the
77 performance of investigative services.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 1702.104, Occupations Code, is amended
1010 to read as follows:
1111 Sec. 1702.104. INVESTIGATIONS COMPANY. (a) A person acts
1212 as an investigations company for the purposes of this chapter if the
1313 person:
1414 (1) engages in the business of obtaining or
1515 furnishing, or accepts employment to obtain or furnish, information
1616 related to:
1717 (A) crime or wrongs done or threatened against a
1818 person, state, or the United States;
1919 (B) the identity, habits, business, occupation,
2020 knowledge, efficiency, loyalty, movement, location, affiliations,
2121 associations, transactions, acts, reputation, or character of a
2222 person;
2323 (C) the location, disposition, or recovery of
2424 lost or stolen property; or
2525 (D) the cause or responsibility for a fire,
2626 libel, loss, accident, damage, or injury to a person or to property;
2727 (2) engages in the business of securing, or accepts
2828 employment to secure, evidence for use before a court, board,
2929 officer, or investigating committee;
3030 (3) engages in the business of securing, or accepts
3131 employment to secure, the electronic tracking of the location of an
3232 individual or motor vehicle other than for criminal justice
3333 purposes by or on behalf of a governmental entity; or
3434 (4) engages in the business of protecting, or accepts
3535 employment to protect, an individual from bodily harm through the
3636 use of a personal protection officer.
3737 (b) For purposes of Subsection (a)(1), obtaining or
3838 furnishing information includes information obtained or furnished
3939 through the review and analysis of, and the investigation into the
4040 content of, computer-based data not available to the public. The
4141 repair or maintenance of a computer does not constitute an
4242 investigation for purposes of this section and does not require
4343 licensing under this chapter if:
4444 (1) the review or analysis of computer-based data is
4545 performed only to diagnose a computer or software problem;
4646 (2) there is no intent to obtain or furnish
4747 information described by Subsection (a)(1); and
4848 (3) the discovery of any information described by
4949 Subsection (a)(1) is inadvertent.
5050 SECTION 2. Subsection (b), Section 1702.324, Occupations
5151 Code, is amended to read as follows:
5252 (b) This chapter does not apply to:
5353 (1) a manufacturer or a manufacturer's authorized
5454 distributor while selling equipment intended for resale;
5555 (2) a person engaged exclusively in the business of
5656 obtaining and providing information to:
5757 (A) determine creditworthiness;
5858 (B) collect debts; or
5959 (C) ascertain the reliability of information
6060 provided by an applicant for property, life, or disability
6161 insurance or an indemnity or surety bond;
6262 (3) a person engaged exclusively in the business of
6363 repossessing property that is secured by a mortgage or other
6464 security interest;
6565 (4) a person who is engaged in the business of
6666 psychological testing or other testing and interviewing services,
6767 including services to determine attitudes, honesty, intelligence,
6868 personality, and skills, for preemployment purposes;
6969 (5) a person who:
7070 (A) is engaged in obtaining information that is a
7171 public record under Chapter 552, Government Code, regardless of
7272 whether the person receives compensation;
7373 (B) is not a full-time employee, as defined by
7474 Section 61.001, Labor Code, of a person licensed under this
7575 chapter; and
7676 (C) does not perform any other act that requires
7777 a license under this chapter;
7878 (6) a licensed engineer practicing engineering or
7979 directly supervising engineering practice under Chapter 1001,
8080 including forensic analysis, burglar alarm system engineering, and
8181 necessary data collection;
8282 (7) an employee of a cattle association who inspects
8383 livestock brands under the authority granted to the cattle
8484 association by the Grain Inspection, Packers and Stockyards
8585 Administration of the United States Department of Agriculture;
8686 (8) a landman performing activities in the course and
8787 scope of the landman's business;
8888 (9) an attorney while engaged in the practice of law;
8989 (10) a person who obtains a document for use in
9090 litigation under an authorization or subpoena issued for a written
9191 or oral deposition;
9292 (11) an admitted insurer, insurance adjuster, agent,
9393 or insurance broker licensed by the state, performing duties in
9494 connection with insurance transacted by that person;
9595 (12) a person who on the person's own property or on
9696 property owned or managed by the person's employer:
9797 (A) installs, changes, or repairs a mechanical
9898 security device;
9999 (B) repairs an electronic security device; or
100100 (C) cuts or makes a key for a security device;
101101 (13) security personnel, including security contract
102102 personnel, working at a commercial nuclear power plant licensed by
103103 the United States Nuclear Regulatory Commission;
104104 (14) a person or firm licensed as an accountant or
105105 accounting firm under Chapter 901, an owner of an accounting firm,
106106 or an employee of an accountant or accounting firm while performing
107107 services regulated under Chapter 901; [or]
108108 (15) a retailer, wholesaler, or other person who sells
109109 mechanical security devices, including locks and deadbolts, but who
110110 does not:
111111 (A) service mechanical security devices for the
112112 public outside of the person's premises; or
113113 (B) claim to act as a locksmith; or
114114 (16) an employee while performing investigative
115115 services that would otherwise be subject to this chapter for an
116116 entity regulated by the:
117117 (A) Texas Department of Insurance;
118118 (B) Office of Thrift Supervision;
119119 (C) Securities and Exchange Commission;
120120 (D) Federal Deposit Insurance Corporation;
121121 (E) National Association of Securities Dealers;
122122 or
123123 (F) Financial Industry Regulatory Authority.
124124 SECTION 3. This Act takes effect immediately if it receives
125125 a vote of two-thirds of all the members elected to each house, as
126126 provided by Section 39, Article III, Texas Constitution. If this
127127 Act does not receive the vote necessary for immediate effect, this
128128 Act takes effect September 1, 2009.
