55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the administration of certain programs to assist
88 certain foster children in obtaining postsecondary education and
99 training.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. (a) In this section:
1212 (1) "Department" means the Department of Family and
1313 Protective Services.
1414 (2) "Program" means the education training and voucher
1515 program component of the John H. Chafee Foster Care Independence
1616 Program (42 U.S.C. Section 677).
1717 (b) The department shall undertake a comprehensive review
1818 of the program as provided by this section.
1919 (c) The department shall develop a program improvement plan
2020 to streamline and improve the administration of the program by:
2121 (1) simplifying the application for participation in
2222 the program by requiring:
2323 (A) proof of enrollment at an institution;
2424 (B) a mid-semester attendance verification; and
2525 (C) only those additional criteria that are
2626 essential to the proper expenditure of funds under the program;
2727 (2) ensuring that program funds are made available to
2828 students before the start of each term, quarter, or semester for
2929 which the funds are needed so that the students are able to use the
3030 funds to secure housing and purchase textbooks;
3131 (3) improving support for students eligible for
3232 program benefits who are struggling financially or academically;
3333 and
3434 (4) providing comprehensive transition planning for:
3535 (A) extended school holidays; or
3636 (B) life after higher education is completed.
3737 (d) In developing the program improvement plan, the
3838 department shall solicit the input of students, the Texas Education
3939 Agency, the Texas Higher Education Coordinating Board, community
4040 colleges, the statewide Youth Leadership Council, and other
4141 interested persons.
4242 (e) The department shall consider contracting with an
4343 outside contractor to assist the department in streamlining the
4444 administration of the program.
4545 (f) Not later than December 1, 2010, the department shall
4646 prepare a report to the legislature regarding the implementation
4747 and success of the program. The report must include the following
4848 information for the two preceding fiscal years:
4949 (1) an analysis of program costs, including:
5050 (A) the amounts appropriated to the department
5151 for the program;
5252 (B) the costs of administering and overseeing the
5353 program;
5454 (C) the total amount of program funds disbursed
5555 to students;
5656 (D) the average amount of program funds disbursed
5757 per student;
5858 (E) the amount of lapsed funds, if any; and
5959 (F) the estimated amount of financial need for
6060 the average student participating in the program not covered by
6161 program funds; and
6262 (2) student data, including:
6363 (A) the number of students eligible for the
6464 program;
6565 (B) the number of students who received program
6666 funds;
6767 (C) the percentage of students receiving program
6868 funds who made satisfactory grades each semester; and
6969 (D) the number of students each year who:
7070 (i) reapplied for program funding; and
7171 (ii) graduated from an institution of
7272 higher education.
7373 (g) The department, with assistance from the Texas Higher
7474 Education Coordinating Board and the Texas Workforce Commission,
7575 shall develop a method to track the outcomes of former foster youth
7676 who participate in the program, including an analysis of the number
7777 of students who received program funds who enter the workforce
7878 after graduation in the field for which they were educated.
7979 SECTION 2. This Act expires September 1, 2011.
8080 SECTION 3. This Act takes effect immediately if it receives
8181 a vote of two-thirds of all the members elected to each house, as
8282 provided by Section 39, Article III, Texas Constitution. If this
8383 Act does not receive the vote necessary for immediate effect, this
8484 Act takes effect September 1, 2009.
