66 AN ACT
77 relating to a documented member of the Kickapoo Traditional Tribe
88 of Texas hunting certain deer.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 42.001(1), Parks and Wildlife Code, is
1111 amended to read as follows:
1212 (1) "Resident" means:
1313 (A) an individual who has resided continuously in
1414 this state for more than six months immediately before applying for
1515 a hunting license;
1616 (B) a member of the United States armed forces on
1717 active duty;
1818 (C) a dependent of a member of the United States
1919 armed forces on active duty; [or]
2020 (D) a member of any other category of individuals
2121 that the commission by regulation designates as residents; or
2222 (E) a member of the Kickapoo Traditional Tribe of
2323 Texas who possesses documentation of membership sanctioned by the
2424 Bureau of Indian Affairs.
2525 SECTION 2. Section 61.021, Parks and Wildlife Code, is
2626 amended to read as follows:
2727 Sec. 61.021. TAKING WILDLIFE RESOURCES PROHIBITED. (a)
2828 Except as provided by Subsection (b) or permitted under a
2929 proclamation issued by the commission under this chapter, no person
3030 may hunt, catch, or possess a game bird or game animal, fish, marine
3131 animal, or other aquatic life at any time or in any place covered by
3232 this chapter.
3333 (b) A documented member of the Kickapoo Traditional Tribe of
3434 Texas who holds a license under Section 42.002 may hunt antlerless
3535 white-tailed deer for religious ceremonial purposes on any day of
3636 the year between one-half hour before sunrise and one-half hour
3737 after sunset. A documented member of the Kickapoo Traditional
3838 Tribe of Texas hunting antlerless white-tailed deer under this
3939 subsection shall:
4040 (1) comply with all other provisions of this code and
4141 proclamations adopted under this code;
4242 (2) notify a local game warden, deputy game warden, or
4343 special game warden at least 24 hours before hunting antlerless
4444 white-tailed deer during an otherwise closed season under the game
4545 laws of this state; and
4646 (3) obtain explicit permission from the landowner
4747 before hunting antlerless white-tailed deer during an otherwise
4848 closed season under the game laws of this state on that landowner's
4949 privately owned property.
5050 SECTION 3. Section 61.057(a), Parks and Wildlife Code, is
5151 amended to read as follows:
5252 (a) Except as provided by Section 61.021 and [in] Subsection
5353 (c) [of this section], no person may hunt an antlerless deer or
5454 antelope in this state without first having acquired an antlerless
5555 deer or antelope permit issued by the department on a form provided
5656 by the department.
5757 SECTION 4. This Act takes effect immediately if it receives
5858 a vote of two-thirds of all the members elected to each house, as
5959 provided by Section 39, Article III, Texas Constitution. If this
6060 Act does not receive the vote necessary for immediate effect, this
6161 Act takes effect September 1, 2009.
