6	6	AN ACT
7	7	relating to a documented member of the Kickapoo Traditional Tribe
8	8	of Texas hunting certain deer.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Section 42.001(1), Parks and Wildlife Code, is
11	11	amended to read as follows:
12	12	(1) "Resident" means:
13	13	(A) an individual who has resided continuously in
14	14	this state for more than six months immediately before applying for
15	15	a hunting license;
16	16	(B) a member of the United States armed forces on
17	17	active duty;
18	18	(C) a dependent of a member of the United States
19	19	armed forces on active duty; [or]
20	20	(D) a member of any other category of individuals
21	21	that the commission by regulation designates as residents; or
22	22	(E) a member of the Kickapoo Traditional Tribe of
23	23	Texas who possesses documentation of membership sanctioned by the
24	24	Bureau of Indian Affairs.
25	25	SECTION 2. Section 61.021, Parks and Wildlife Code, is
26	26	amended to read as follows:
27	27	Sec. 61.021. TAKING WILDLIFE RESOURCES PROHIBITED. (a)
28	28	Except as provided by Subsection (b) or permitted under a
29	29	proclamation issued by the commission under this chapter, no person
30	30	may hunt, catch, or possess a game bird or game animal, fish, marine
31	31	animal, or other aquatic life at any time or in any place covered by
32	32	this chapter.
33	33	(b) A documented member of the Kickapoo Traditional Tribe of
34	34	Texas who holds a license under Section 42.002 may hunt antlerless
35	35	white-tailed deer for religious ceremonial purposes on any day of
36	36	the year between one-half hour before sunrise and one-half hour
37	37	after sunset. A documented member of the Kickapoo Traditional
38	38	Tribe of Texas hunting antlerless white-tailed deer under this
39	39	subsection shall:
40	40	(1) comply with all other provisions of this code and
41	41	proclamations adopted under this code;
42	42	(2) notify a local game warden, deputy game warden, or
43	43	special game warden at least 24 hours before hunting antlerless
44	44	white-tailed deer during an otherwise closed season under the game
45	45	laws of this state; and
46	46	(3) obtain explicit permission from the landowner
47	47	before hunting antlerless white-tailed deer during an otherwise
48	48	closed season under the game laws of this state on that landowner's
49	49	privately owned property.
50	50	SECTION 3. Section 61.057(a), Parks and Wildlife Code, is
51	51	amended to read as follows:
52	52	(a) Except as provided by Section 61.021 and [in] Subsection
53	53	(c) [of this section], no person may hunt an antlerless deer or
54	54	antelope in this state without first having acquired an antlerless
55	55	deer or antelope permit issued by the department on a form provided
56	56	by the department.
57	57	SECTION 4. This Act takes effect immediately if it receives
58	58	a vote of two-thirds of all the members elected to each house, as
59	59	provided by Section 39, Article III, Texas Constitution. If this
60	60	Act does not receive the vote necessary for immediate effect, this
61	61	Act takes effect September 1, 2009.
