77 relating to transfer of certain probate matters and guardianship
88 matters.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 5B(a), Texas Probate Code, is amended to
1111 read as follows:
1212 (a) A judge of a statutory probate court, on the motion of a
1313 party to the action or on the motion of a person interested in an
1414 estate, may transfer to his court from a district, county, or
1515 statutory court a cause of action appertaining to or incident to an
1616 estate pending in the statutory probate court or a cause of action
1717 in which a personal representative of an estate pending in the
1818 statutory probate court is a party and may consolidate the
1919 transferred cause of action with the other proceedings in the
2020 statutory probate court relating to that estate. The judge of a
2121 statutory probate court may transfer a cause of action described by
2222 this subsection to the judge's court only if venue would otherwise
2323 be proper or mandatory in the county of that statutory probate
2424 court.
2525 SECTION 2. Section 608, Texas Probate Code, is amended to
2626 read as follows:
2727 Sec. 608. TRANSFER OF GUARDIANSHIP PROCEEDING. A judge of a
2828 statutory probate court, on the motion of a party to the action or
2929 of a person interested in a guardianship, may transfer to the
3030 judge's court from a district, county, or statutory court a cause of
3131 action appertaining to or incident to a guardianship estate that is
3232 pending in the statutory probate court or a cause of action relating
3333 to a guardianship in which a guardian, ward, or proposed ward in a
3434 guardianship pending in the statutory probate court is a party and
3535 may consolidate the transferred cause of action with the other
3636 proceedings in the statutory probate court relating to the
3737 guardianship estate. The judge of a statutory probate court may
3838 transfer a cause of action described by this section to the judge's
3939 court only if venue would otherwise be proper or mandatory in the
4040 county of that statutory probate court.
4141 SECTION 3. This Act takes effect September 1, 2009.
