66 AN ACT
77 relating to the fee based on admissions to certain sexually
88 oriented businesses.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 47.052(a), Business & Commerce Code, is
1111 amended to read as follows:
1212 (a) A fee is imposed on a sexually oriented business in an
1313 amount equal to $3 [$5] for each entry by each customer admitted to
1414 the business.
1515 SECTION 2. Section 47.054, Business & Commerce Code, is
1616 amended to read as follows:
1717 Sec. 47.054. ALLOCATION OF [CERTAIN] REVENUE FOR SEXUAL
1818 ASSAULT PROGRAMS. The comptroller shall deposit the amount [first
1919 $25 million] received from the fee imposed under this subchapter
2020 [in a state fiscal biennium] to the credit of the sexual assault
2121 program fund.
2222 SECTION 3. Sections 47.055 and 47.0551, Business & Commerce
2323 Code, are repealed.
2424 SECTION 4. The changes in law made by this Act apply only to
2525 a fee imposed for the admission of a customer to a sexually oriented
2626 business on or after the effective date of this Act.
2727 SECTION 5. This Act takes effect immediately if it receives
2828 a vote of two-thirds of all the members elected to each house, as
2929 provided by Section 39, Article III, Texas Constitution. If this
3030 Act does not receive the vote necessary for immediate effect, this
3131 Act takes effect September 1, 2009.
