55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the duty of the General Land Office to clean, maintain,
88 and clear debris from a public beach affected by a declared
99 disaster.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 61.067, Natural Resources Code, is
1212 amended by adding Subsection (a-1) to read as follows:
1313 (a-1) Notwithstanding Sections 61.065 and 61.066, the land
1414 office shall clean, maintain, and clear debris from a public beach
1515 that is located in an area designated as a threatened area in a
1616 declaration of a state of disaster issued under Section 418.014,
1717 Government Code. The duty of the land office under this subsection
1818 is limited to debris related to the event that is the subject of the
1919 disaster declaration.
2020 SECTION 2. Section 61.082(a), Natural Resources Code, is
2121 amended to read as follows:
2222 (a) Except as provided by Section 61.067(a-1), the [The]
2323 provisions of this subchapter shall not be construed to interfere
2424 with local initiative and responsibility in the cleaning,
2525 maintenance, and supervision of public beaches.
2626 SECTION 3. This Act takes effect immediately if it receives
2727 a vote of two-thirds of all the members elected to each house, as
2828 provided by Section 39, Article III, Texas Constitution. If this
2929 Act does not receive the vote necessary for immediate effect, this
3030 Act takes effect September 1, 2009.
