7 | 7 | | relating to the duty of the General Land Office to clean, maintain, |

8 | 8 | | and clear debris from a public beach affected by a declared |
---|
9 | 9 | | disaster. |

10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Section 61.067, Natural Resources Code, is |
---|
12 | 12 | | amended by adding Subsection (a-1) to read as follows: |
---|
13 | 13 | | (a-1) Notwithstanding Sections 61.065 and 61.066, the land |
---|
14 | 14 | | office shall clean, maintain, and clear debris from a public beach |
---|
15 | 15 | | that is located in an area designated as a threatened area in a |
---|
16 | 16 | | declaration of a state of disaster issued under Section 418.014, |
---|
17 | 17 | | Government Code. The duty of the land office under this subsection |
---|
18 | 18 | | is limited to debris related to the event that is the subject of the |
---|
19 | 19 | | disaster declaration. |
---|
20 | 20 | | SECTION 2. Section 61.082(a), Natural Resources Code, is |
---|
21 | 21 | | amended to read as follows: |
---|
22 | 22 | | (a) Except as provided by Section 61.067(a-1), the [The] |
---|
23 | 23 | | provisions of this subchapter shall not be construed to interfere |
---|
24 | 24 | | with local initiative and responsibility in the cleaning, |
---|
25 | 25 | | maintenance, and supervision of public beaches. |
---|
26 | 26 | | SECTION 3. This Act takes effect immediately if it receives |
---|
27 | 27 | | a vote of two-thirds of all the members elected to each house, as |
---|
28 | 28 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
29 | 29 | | Act does not receive the vote necessary for immediate effect, this |
---|
30 | 30 | | Act takes effect September 1, 2009. |
