9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 46.15, Penal Code, is amended by adding | |
11 | 11 | Subsection (g) to read as follows: | |
12 | 12 | (g) The provisions of Sections 46.02 and 46.03 prohibiting | |
13 | 13 | the possession or carrying of a club do not apply to an animal | |
14 | 14 | control officer, as defined by Section 829.001, Health and Safety | |
15 | 15 | Code, who possesses or carries an instrument used specifically for | |
16 | 16 | deterring the bite of an animal while the officer is in the | |
17 | 17 | performance of official duties under the Health and Safety Code or | |
18 | 18 | is traveling to or from a place of duty. | |
19 | 19 | SECTION 2. This Act takes effect immediately if it receives | |
20 | 20 | a vote of two-thirds of all the members elected to each house, as | |
21 | 21 | provided by Section 39, Article III, Texas Constitution. If this | |
22 | 22 | Act does not receive the vote necessary for immediate effect, this | |
23 | 23 | Act takes effect September 1, 2009. |
