| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 43.251(c), Penal Code, is amended to | |
| 11 | 11 | read as follows: | |
| 12 | 12 | (c) An offense under this section is a Class A misdemeanor, | |
| 13 | 13 | unless it is shown on the trial of the offense that the defendant | |
| 14 | 14 | has previously been convicted under this section, in which event | |
| 15 | 15 | the offense is a felony of the third degree. | |
| 16 | 16 | SECTION 2. The change in law made by this Act applies only to | |
| 17 | 17 | an offense committed on or after the effective date of this Act. An | |
| 18 | 18 | offense committed before the effective date of this Act is covered | |
| 19 | 19 | by the law in effect when the offense was committed, and the former | |
| 20 | 20 | law is continued in effect for that purpose. For purposes of this | |
| 21 | 21 | section, an offense was committed before the effective date of this | |
| 22 | 22 | Act if any element of the offense was committed before that date. | |
| 23 | 23 | SECTION 3. This Act takes effect September 1, 2009. |
