| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 2175.304, Government Code, is amended by | |
| 11 | 11 | adding Subsection (e) to read as follows: | |
| 12 | 12 | (e) Notwithstanding Subsections (b) and (c), a university | |
| 13 | 13 | system or institution or agency of higher education included within | |
| 14 | 14 | the definition of "state agency" under Section 2151.002 may donate | |
| 15 | 15 | data processing equipment that is surplus property to a public or | |
| 16 | 16 | private hospital located in a rural county. For purposes of this | |
| 17 | 17 | subsection, "rural county" has the meaning assigned by Section | |
| 18 | 18 | 487.301. | |
| 19 | 19 | SECTION 2. This Act takes effect immediately if it receives | |
| 20 | 20 | a vote of two-thirds of all the members elected to each house, as | |
| 21 | 21 | provided by Section 39, Article III, Texas Constitution. If this | |
| 22 | 22 | Act does not receive the vote necessary for immediate effect, this | |
| 23 | 23 | Act takes effect September 1, 2009. |
