55 relating to a study on the feasibility of providing vaccines to
66 first responders deployed to a disaster area.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. (a) In this Act:
99 (1) "Department" means the Department of State Health
1010 Services.
1111 (2) "Disaster" means:
1212 (A) a public health disaster as defined by
1313 Section 81.003, Health and Safety Code;
1414 (B) a natural or man-made disaster;
1515 (C) a terrorist attack;
1616 (D) a hostile military or paramilitary action;
1717 (E) an extraordinary law enforcement emergency;
1818 or
1919 (F) any other state of disaster declared under
2020 Chapter 418, Government Code.
2121 (3) "First responder" has the meaning assigned by
2222 Section 421.095, Government Code.
2323 (b) The department shall conduct a study to determine the
2424 feasibility of providing vaccines to:
2525 (1) a first responder who may be exposed to
2626 vaccine-preventable diseases during the responder's deployment to
2727 a disaster area; and
2828 (2) the immediate family members of a first responder
2929 to whom the first responder may transmit a vaccine-preventable
3030 disease after deployment to a disaster area.
3131 (c) The study must consider the feasibility of providing the
3232 following vaccines:
3333 (1) the hepatitis B vaccine for first responders who
3434 may be in direct contact with blood and other bodily fluids;
3535 (2) a tetanus-containing vaccine; and
3636 (3) other vaccines or biologicals recommended by the
3737 Centers for Disease Control and Prevention for disasters.
3838 (d) The department shall:
3939 (1) assess the vaccination status of first responders
4040 and their immediate family members in this state;
4141 (2) assess workplace immunization policies and
4242 insurance coverage for first responders;
4343 (3) make recommendations on educating first
4444 responders and their immediate family members about available
4545 options to obtain immunization services, regardless of insurance
4646 coverage;
4747 (4) assess the current ability of the department, in
4848 conjunction with local health departments, to provide vaccines to
4949 first responders and their immediate family members who are
5050 uninsured or underinsured;
5151 (5) identify and recommend funding sources for the
5252 procurement of recommended vaccines for first responders and their
5353 immediate family members who are uninsured or underinsured; and
5454 (6) evaluate the potential use and cost of providing
5555 other biologicals, such as immune globulin, to be used in
5656 conjunction with vaccines to prevent the spread of
5757 vaccine-preventable diseases.
5858 (e) The statewide wellness coordinator designated under
5959 Subsection (a), Section 664.053, Government Code, shall assist the
6060 department in obtaining data from state agencies that employ first
6161 responders by:
6262 (1) consulting with the wellness liaison identified
6363 under Subsection (d), Section 664.053, Government Code, for a state
6464 agency that employs first responders to gain study-related
6565 information from the state agency;
6666 (2) assessing the readiness of each state agency to
6767 administer vaccines to the agency's first responders before
6868 deployment to a disaster area; and
6969 (3) providing to the department appropriate
7070 information from state agencies regarding the current immunization
7171 policies of those agencies.
7272 (f) A state agency that provides data to the department for
7373 purposes of the study shall ensure that the data does not identify a
7474 first responder or family member of a first responder to whom the
7575 data pertains.
7676 (g) Not later than August 1, 2011, the department shall
7777 submit to the legislature a written report containing the findings
7878 of the study and the department's recommendations.
7979 (h) This section expires September 1, 2011.
8080 SECTION 2. This Act takes effect immediately if it receives
8181 a vote of two-thirds of all the members elected to each house, as
8282 provided by Section 39, Article III, Texas Constitution. If this
8383 Act does not receive the vote necessary for immediate effect, this
8484 Act takes effect September 1, 2009.
