| 7 | 7 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 8 | 8 | SECTION 1. Section 262.114, Family Code, is amended by | |
| 9 | 9 | adding Subsection (c) to read as follows: | |
| 10 | 10 | (c) The department shall consider placing a child who has | |
| 11 | 11 | previously been in the managing conservatorship of the department | |
| 12 | 12 | with a foster parent with whom the child previously resided if: | |
| 13 | 13 | (1) the department determines that placement of the | |
| 14 | 14 | child with a relative or designated caregiver is not in the child's | |
| 15 | 15 | best interest; and | |
| 16 | 16 | (2) the placement is available and in the child's best | |
| 17 | 17 | interest. | |
| 18 | 18 | SECTION 2. This Act takes effect September 1, 2009. | |
