A BILL TO BE ENTITLED
AN ACT
relating to the purchase and sale of certain alcoholic beverages by
the holder of a winery permit.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Chapter 16, Alcoholic Beverage Code, is amended
by adding Section 16.10 to read as follows:
Sec. 16.10. PURCHASE AND SALE OF MALT BEVERAGES. (a) The
holder of a winery permit may sell beer and malt liquor on the
winery permit holder's permitted premises for on-premises
consumption only during a reception or similar event where full
meals are served.
(b) The holder of a winery permit may purchase beer or malt
liquor from any license or permit holder authorized to sell the beer
or malt liquor for resale.
(c) The holder of a winery permit who also holds a private
carrier permit may transport the beer or malt liquor from the place
of purchase to the winery permit holder's premises.
SECTION 2. This Act takes effect September 1, 2009.
