55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the holidays for members of fire and police departments
88 in certain municipalities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 142.0013, Local Government Code, is
1111 amended by adding Subsection (d) to read as follows:
1212 (d) A fire fighter or police officer is entitled to a paid
1313 day off from working on September 11 of each year if:
1414 (1) the fire fighter or police officer:
1515 (A) agrees or is required to work on a holiday
1616 during the same fiscal year and chooses to take that holiday on
1717 September 11; or
1818 (B) chooses to use a vacation day, a day in lieu
1919 of a vacation day or holiday, or accumulated compensatory leave to
2020 take a paid day off on September 11; and
2121 (2) the fire fighter's or police officer's supervisor
2222 does not require the fire fighter or police officer to work that day
2323 to maintain minimum staffing necessary for public safety.
2424 SECTION 2. This Act takes effect September 1, 2009.
