9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 142.0013, Local Government Code, is | |
11 | 11 | amended by adding Subsection (d) to read as follows: | |
12 | 12 | (d) A fire fighter or police officer is entitled to a paid | |
13 | 13 | day off from working on September 11 of each year if: | |
14 | 14 | (1) the fire fighter or police officer: | |
15 | 15 | (A) agrees or is required to work on a holiday | |
16 | 16 | during the same fiscal year and chooses to take that holiday on | |
17 | 17 | September 11; or | |
18 | 18 | (B) chooses to use a vacation day, a day in lieu | |
19 | 19 | of a vacation day or holiday, or accumulated compensatory leave to | |
20 | 20 | take a paid day off on September 11; and | |
21 | 21 | (2) the fire fighter's or police officer's supervisor | |
22 | 22 | does not require the fire fighter or police officer to work that day | |
23 | 23 | to maintain minimum staffing necessary for public safety. | |
24 | 24 | SECTION 2. This Act takes effect September 1, 2009. |
