55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to certificates of public convenience and necessity for
88 water or sewer services.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 13.254, Water Code, is amended by
1111 amending Subsections (a-1) and (a-3) to read as follows:
1212 (a-1) As an alternative to decertification under Subsection
1313 (a), the owner of a tract of land that is at least 25 [50] acres and
1414 that is not in a platted subdivision actually receiving water or
1515 sewer service may petition the commission under this subsection for
1616 expedited release of the area from a certificate of public
1717 convenience and necessity [so that the area may receive service
1818 from another retail public utility. The petitioner shall deliver,
1919 via certified mail, a copy of the petition to the certificate
2020 holder, who may submit information to the commission to controvert
2121 information submitted by the petitioner. The petitioner must
2222 demonstrate that:
2323 [(1) a written request for service, other than a
2424 request for standard residential or commercial service, has been
2525 submitted to the certificate holder, identifying:
2626 [(A) the area for which service is sought;
2727 [(B) the timeframe within which service is needed
2828 for current and projected service demands in the area;
2929 [(C) the level and manner of service needed for
3030 current and projected service demands in the area; and
3131 [(D) any additional information requested by the
3232 certificate holder that is reasonably related to determination of
3333 the capacity or cost for providing the service;
3434 [(2) the certificate holder has been allowed at least
3535 90 calendar days to review and respond to the written request and
3636 the information it contains;
3737 [(3) the certificate holder:
3838 [(A) has refused to provide the service;
3939 [(B) is not capable of providing the service on a
4040 continuous and adequate basis within the timeframe, at the level,
4141 or in the manner reasonably needed or requested by current and
4242 projected service demands in the area; or
4343 [(C) conditions the provision of service on the
4444 payment of costs not properly allocable directly to the
4545 petitioner's service request, as determined by the commission; and
4646 [(4) the alternate retail public utility from which
4747 the petitioner will be requesting service is capable of providing
4848 continuous and adequate service within the timeframe, at the level,
4949 and in the manner reasonably needed or requested by current and
5050 projected service demands in the area].
5151 (a-3) Within 60 [90] calendar days from the date the
5252 petition is filed with the commission [determines the petition
5353 filed pursuant to Subsection (a-1) to be administratively
5454 complete], the commission shall grant the petition [unless the
5555 commission makes an express finding that the petitioner failed to
5656 satisfy the elements required in Subsection (a-1) and supports its
5757 finding with separate findings and conclusions for each element
5858 based solely on the information provided by the petitioner and the
5959 certificate holder. The commission may grant or deny a petition
6060 subject to terms and conditions specifically related to the service
6161 request of the petitioner and all relevant information submitted by
6262 the petitioner and the certificate holder]. The commission may not
6363 deny a petition based on the fact that a certificate holder is a
6464 borrower under a federal loan program. In addition, the commission
6565 may require an award of compensation as otherwise provided by this
6666 section.
6767 SECTION 2. The changes in law made by Section 13.254, Water
6868 Code, as amended by this Act, apply only to a petition filed on or
6969 after the effective date of this Act. A petition filed before the
7070 effective date of this Act is subject to the law in effect on the
7171 date the petition is filed, and that law is continued in effect for
7272 that purpose.
7373 SECTION 3. This Act takes effect September 1, 2009.
