| 10 | 10 | | including limiting school day interruptions that affect such |
|---|
| 11 | 11 | | attendance. |
|---|
| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Section 25.083, Education Code, is amended to |
|---|
| 14 | 14 | | read as follows: |
|---|
| 15 | 15 | | Sec. 25.083. SCHOOL DAY INTERRUPTIONS. (a) The board of |
|---|
| 16 | 16 | | trustees of each school district shall adopt and strictly enforce a |
|---|
| 17 | 17 | | policy limiting interruptions of classes during the school day for |
|---|
| 18 | 18 | | nonacademic activities such as announcements and sales promotions. |
|---|
| 19 | 19 | | At a minimum, the policy must limit announcements other than |
|---|
| 20 | 20 | | emergency announcements to once during the school day. |
|---|
| 21 | 21 | | (b) The board of trustees of each school district shall |
|---|
| 22 | 22 | | adopt and strictly enforce a policy limiting the removal of |
|---|
| 23 | 23 | | students from class for remedial tutoring or test preparation. A |
|---|
| 24 | 24 | | district may not remove a student from a regularly scheduled class |
|---|
| 25 | 25 | | for remedial tutoring or test preparation if, as a result of the |
|---|
| 26 | 26 | | removal, the student would miss more than 10 percent of the school |
|---|
| 27 | 27 | | days on which the class is offered, unless the student's parent or |
|---|
| 28 | 28 | | another person standing in parental relation to the student |
|---|
| 29 | 29 | | provides to the district written consent for removal from class for |
|---|
| 30 | 30 | | such purpose. |

| 31 | 31 | | SECTION 2. Subsection (a), Section 25.092, Education Code, |
|---|
| 32 | 32 | | is amended to read as follows: |
|---|
| 33 | 33 | | (a) Except as provided by this section, a student in any |
|---|
| 34 | 34 | | grade level from kindergarten through grade 12 may not be given |
|---|
| 35 | 35 | | credit for a class unless the student is in attendance for at least |
|---|
| 36 | 36 | | 90 percent of the days the class is offered. |
|---|
| 37 | 37 | | SECTION 3. Section 29.0821, Education Code, is amended by |
|---|
| 38 | 38 | | adding Subsection (f) to read as follows: |
|---|
| 39 | 39 | | (f) Section 25.092 does not apply to a student's attendance |
|---|
| 40 | 40 | | and nonattendance in a flexible year program under this section. |
|---|
| 41 | 41 | | SECTION 4. This Act applies beginning with the 2009-2010 |
|---|
| 42 | 42 | | school year. |
|---|
| 43 | 43 | | SECTION 5. This Act takes effect immediately if it receives |
|---|
| 44 | 44 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 45 | 45 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 46 | 46 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 47 | 47 | | Act takes effect September 1, 2009. |
