99 relating to minimum public school attendance for class credit,
1010 including limiting school day interruptions that affect such
1111 attendance.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 25.083, Education Code, is amended to
1414 read as follows:
1515 Sec. 25.083. SCHOOL DAY INTERRUPTIONS. (a) The board of
1616 trustees of each school district shall adopt and strictly enforce a
1717 policy limiting interruptions of classes during the school day for
1818 nonacademic activities such as announcements and sales promotions.
1919 At a minimum, the policy must limit announcements other than
2020 emergency announcements to once during the school day.
2121 (b) The board of trustees of each school district shall
2222 adopt and strictly enforce a policy limiting the removal of
2323 students from class for remedial tutoring or test preparation. A
2424 district may not remove a student from a regularly scheduled class
2525 for remedial tutoring or test preparation if, as a result of the
2626 removal, the student would miss more than 10 percent of the school
2727 days on which the class is offered, unless the student's parent or
2828 another person standing in parental relation to the student
2929 provides to the district written consent for removal from class for
3030 such purpose.
3131 SECTION 2. Subsection (a), Section 25.092, Education Code,
3232 is amended to read as follows:
3333 (a) Except as provided by this section, a student in any
3434 grade level from kindergarten through grade 12 may not be given
3535 credit for a class unless the student is in attendance for at least
3636 90 percent of the days the class is offered.
3737 SECTION 3. Section 29.0821, Education Code, is amended by
3838 adding Subsection (f) to read as follows:
3939 (f) Section 25.092 does not apply to a student's attendance
4040 and nonattendance in a flexible year program under this section.
4141 SECTION 4. This Act applies beginning with the 2009-2010
4242 school year.
4343 SECTION 5. This Act takes effect immediately if it receives
4444 a vote of two-thirds of all the members elected to each house, as
4545 provided by Section 39, Article III, Texas Constitution. If this
4646 Act does not receive the vote necessary for immediate effect, this
4747 Act takes effect September 1, 2009.
