| 6 | 6 | | crime fund and the compensation to victims of crime auxiliary fund. |

| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Article 56.54, Code of Criminal Procedure, is |
|---|
| 9 | 9 | | amended by adding Subsection (m) to read as follows: |
|---|
| 10 | 10 | | (m) Not later than September 15 of each year, the attorney |
|---|
| 11 | 11 | | general, after consulting with the comptroller, shall certify the |
|---|
| 12 | 12 | | amount of money remaining in the compensation to victims of crime |
|---|
| 13 | 13 | | auxiliary fund at the end of the preceding state fiscal year. If |
|---|
| 14 | 14 | | the amount remaining in the fund exceeds $5 million, as soon as |
|---|
| 15 | 15 | | practicable after the date of certification, the attorney general |
|---|
| 16 | 16 | | may transfer from that excess amount in the compensation to victims |
|---|
| 17 | 17 | | of crime auxiliary fund to the compensation to victims of crime fund |
|---|
| 18 | 18 | | an amount that is not more than 50 percent of the excess amount in |
|---|
| 19 | 19 | | the auxiliary fund, to be used only for the purpose of making |
|---|
| 20 | 20 | | compensation payments during the fiscal year in which the amount is |
|---|
| 21 | 21 | | transferred. |

| 22 | 22 | | SECTION 2. Subsection (b), Article 56.541, Code of Criminal |
|---|
| 23 | 23 | | Procedure, is amended to read as follows: |
|---|
| 24 | 24 | | (b) At the time the attorney general certifies the estimates |
|---|
| 25 | 25 | | made under Subsection (a), the attorney general shall also certify |
|---|
| 26 | 26 | | for the next state fiscal biennium the amount of excess money in the |
|---|
| 27 | 27 | | compensation to victims of crime fund available for the purposes of |
|---|
| 28 | 28 | | Subsection (c), calculated by multiplying [subtracting] the amount |
|---|
| 29 | 29 | | estimated under Subsection (a)(2) by 105 percent, and subtracting |
|---|
| 30 | 30 | | that product from the sum of the amounts estimated under |
|---|
| 31 | 31 | | Subsections (a)(1) and (a)(3). |
|---|
| 32 | 32 | | SECTION 3. The attorney general may not transfer money |
|---|
| 33 | 33 | | under Subsection (m), Article 56.54, Code of Criminal Procedure, as |
|---|
| 34 | 34 | | added by this Act, before the 2011 state fiscal year. |

| 35 | 35 | | SECTION 4. This Act takes effect September 1, 2009. |
