1010 A BILL TO BE ENTITLED
1111 AN ACT
1212 relating to delinquent payment of an alcoholic beverage retailer's
1313 account for liquor.
1414 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1515 SECTION 1. Section 102.32, Alcoholic Beverage Code, is
1616 amended by adding Subsection (d-1) to read as follows:
1717 (d-1) The commission or administrator may not accept the
1818 voluntary cancellation or suspension of a permit or allow a permit
1919 to be renewed or transferred if the permit holder is delinquent in
2020 the payment of an account for liquor under this section. A person
2121 whose permit is canceled by the commission or whose permit has
2222 expired is not eligible to hold any other permit or license under
2323 this code until the person has cured any delinquency of the person
2424 under this section.
2525 SECTION 2. This Act takes effect immediately if it receives
2626 a vote of two-thirds of all the members elected to each house, as
2727 provided by Section 39, Article III, Texas Constitution. If this
2828 Act does not receive the vote necessary for immediate effect, this
2929 Act takes effect September 1, 2009.
