88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 431.082, Government Code, is amended by
1010 adding Subsection (d) to read as follows:
1111 (d) A member of the Texas State Guard called to state active
1212 duty is a temporary employee of the state while on state active
1313 duty. The adjutant general shall pay members of the Texas State
1414 Guard called to state active duty according to the General
1515 Appropriations Act. If the length of state active duty exceeds 45
1616 consecutive days, the adjutant general may pay the members of the
1717 Texas State Guard called to state active duty up to 140 percent of
1818 the amount authorized in the General Appropriations Act.
1919 SECTION 2. This Act takes effect immediately if it receives
2020 a vote of two-thirds of all the members elected to each house, as
2121 provided by Section 39, Article III, Texas Constitution. If this
2222 Act does not receive the vote necessary for immediate effect, this
2323 Act takes effect September 1, 2009.
