55 relating to the definition of first responder for purposes of the
66 immunization registry.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Subdivision (1-a), Section 161.0001, Health and
99 Safety Code, is amended to read as follows:
1010 (1-a) "First responder" means:
1111 (A) any federal, state, local, or private
1212 personnel who may respond to a disaster, including:
1313 (i) public health and public safety
1414 personnel;
1515 (ii) commissioned law enforcement
1616 personnel;
1717 (iii) fire protection personnel, including
1818 volunteer firefighters;
1919 (iv) emergency medical services personnel,
2020 including hospital emergency facility staff;
2121 (v) a member of the National Guard;
2222 (vi) a member of the Texas State Guard; or
2323 (vii) any other worker who responds to a
2424 disaster in the worker's scope of employment; or
2525 (B) any related personnel that provide support
2626 services during the prevention, response, and recovery phases of a
2727 disaster [has the meaning assigned by Section 421.095, Government
2828 Code].
2929 SECTION 2. This Act takes effect immediately if it receives
3030 a vote of two-thirds of all the members elected to each house, as
3131 provided by Section 39, Article III, Texas Constitution. If this
3232 Act does not receive the vote necessary for immediate effect, this
3333 Act takes effect September 1, 2009.
