| 5 | 5 | | relating to the definition of first responder for purposes of the |

| 6 | 6 | | immunization registry. |

| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Subdivision (1-a), Section 161.0001, Health and |
|---|
| 9 | 9 | | Safety Code, is amended to read as follows: |
|---|
| 10 | 10 | | (1-a) "First responder" means: |
|---|
| 11 | 11 | | (A) any federal, state, local, or private |
|---|
| 12 | 12 | | personnel who may respond to a disaster, including: |
|---|
| 13 | 13 | | (i) public health and public safety |
|---|
| 14 | 14 | | personnel; |
|---|
| 15 | 15 | | (ii) commissioned law enforcement |
|---|
| 16 | 16 | | personnel; |
|---|
| 17 | 17 | | (iii) fire protection personnel, including |
|---|
| 18 | 18 | | volunteer firefighters; |
|---|
| 19 | 19 | | (iv) emergency medical services personnel, |
|---|
| 20 | 20 | | including hospital emergency facility staff; |
|---|
| 21 | 21 | | (v) a member of the National Guard; |
|---|
| 22 | 22 | | (vi) a member of the Texas State Guard; or |
|---|
| 23 | 23 | | (vii) any other worker who responds to a |
|---|
| 24 | 24 | | disaster in the worker's scope of employment; or |
|---|
| 25 | 25 | | (B) any related personnel that provide support |
|---|
| 26 | 26 | | services during the prevention, response, and recovery phases of a |
|---|
| 27 | 27 | | disaster [has the meaning assigned by Section 421.095, Government |
|---|
| 28 | 28 | | Code]. |
|---|
| 29 | 29 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 30 | 30 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 31 | 31 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 32 | 32 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 33 | 33 | | Act takes effect September 1, 2009. |
