99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sec. 201.105(a) and (b), Transportation Code are
1111 amended to read as follows:
1212 Sec. 201.105. DEPARTMENT DISTRICTS. (a) The commission
1313 shall divide the state into [not more than] 25 districts for the
1414 purpose of the performance of the department's duties.
1515 (b) The [In determining a district's boundaries, the]
1616 commission shall align the district boundaries along the boundaries
1717 of the councils of government and consider all costs and benefits,
1818 including highway activity in determining[and] the number of
1919 employees required for the districts [proposed district].
2020 SECTION 2. Subchapter H, Chapter 201, Transportation Code,
2121 is amended by adding Section 201.6001 to read as follows:
2222 Sec. 201.6001 DEFINITIONS (a) In this Subchapter:
2323 (1) "Local government" means a county or municipality.
2424 (2) "Planning organization" means a metropolitan
2525 planning organization, a rural planning organization, or the
2626 department district.
2727 (3) "Project cost" means the total cost of a
2828 transportation project including all costs associated with the
2929 following:
3030 (A) planning;
3131 (B) design;
3232 (C) environmental assessment;
3333 (D) right-of-way acquisition;
3434 (E) construction;
3535 (F) operations;
3636 (G) maintenance;
3737 (H) overruns; and
3838 (I) change orders.
3939 (4) "Region" means the area of the metropolitan
4040 planning organization or the area outside the boundaries of the
4141 metropolitan planning organization that make up the remainder of
4242 the council of government.
4343 (5) "Rural planning organization" means a planning
4444 organization created in accordance with Section 201.6002.
4545 (6) "Transportation official" means officials from
4646 other state agencies and political subdivisions that have
4747 responsibility for the following modes of transportation:
4848 (A) aviation;
4949 (B) high-speed railroads;
5050 (C) highways;
5151 (D) toll roads;
5252 (E) mass transportation;
5353 (F) railroads; and
5454 (G) water traffic
5555 (7) "Transportation project" means:
5656 (A) the planning, right-of-way acquisition,
5757 expansion, improvement, addition, routine maintenance, contracted
5858 routine maintenance, or contract maintenance of a:
5959 (i) bridge
6060 (ii) highway;
6161 (iii) toll road or toll road system; or
6262 (iv) railroad.
6363 (B) projects which enhance the safety of a
6464 roadway to the traveling public;
6565 (C) an air quality improvement initiative;
6666 (D) an enhancement project in accordance with 23
6767 U.S.C. 133; or
6868 (E) mass transportation.
6969 SECTION 3. Subchapter H, Chapter 201, Transportation Code,
7070 is amended by adding Section 201.6002 to read as follows:
7171 Sec. 201.6002. RURAL PLANNING ORGANIZATIONS. (a) To carry
7272 out the transportation planning process required by this section, a
7373 rural planning organization may be created that covers all of the
7474 area that is within the boundaries of a council of government and
7575 outside the boundaries of a metropolitan planning organization if
7676 the units of local government that together represent at least 75
7777 percent of the affected population agree to the creation of the
7878 organization.
7979 (b) A rural planning organization is governed by a board of
8080 directors composed of local elected officials and the district
8181 engineer of the department district.
8282 (c) In order for a rural planning organization to be
8383 eligible to receive funding from the state for transportation
8484 projects under Section 201.6012, Transportation Code, the make up
8585 of the voting members of the board must include at least 50 percent
8686 elected officials, which are elected within the boundaries of the
8787 rural planning organization.
8888 (d) As soon as practicable after a rural planning
8989 organization is created, the organization shall send notice of its
9090 creation to the commission.
9191 (e) The department may use money in the state highway fund
9292 to fund the operations of a rural planning organization subject to
9393 the limitation set forth in Section 201.6012(h).
9494 (f) A rural planning organization shall develop
9595 transportation plans and programs for its service area in
9696 accordance with Section 201.601.
9797 (g) A rural planning organization may provide to the
9898 commission recommendations concerning the selection of
9999 transportation projects, systems, or programs to be undertaken
100100 within the boundaries of the rural planning organization.
101101 (h) In this section "elected official" is defined as mayor,
102102 county judge, city council member, county commissioner, state
103103 representative, or state senator.
104104 SECTION 4. Section 201.601, Transportation Code, is amended
105105 to read as follows:
106106 Sec. 201.601. STATEWIDE TRANSPORTATION PROGRAM AND BUDGET
107107 [PLAN]. (a) On September first of every odd numbered year
108108 following the legislative session, the Chief Financial Officer
109109 shall issue a cash flow forecast for each method and category of
110110 funding which covers a period to include the next ten years. The
111111 forecast shall identify all sources of funding available for
112112 transportation projects including bond proceeds. The first two
113113 years of the forecast shall be based on the appropriation of funds
114114 in the general appropriations act for the department.
115115 (b) The Commission shall utilize the cash forecast to
116116 allocate funding to the department districts in accordance with
117117 Section 201.6012. The funds shall be deposited into a subaccount
118118 within the State Highway Fund. The balance of the subaccount shall
119119 be carried forward from year to year for the benefit of the region.
120120 (c) The planning organization shall develop a ten year
121121 transportation plan utilizing the funding allocated to the region.
122122 The first four years of the plan shall be developed in order to
123123 fulfill the transportation improvement plan requirements of 23
124124 U.S.C. 135. The department shall compile the region's project
125125 selections to develop the statewide transportation plan in
126126 accordance with 23 U.S.C. 135. If there is a Metropolitan Planning
127127 Organization within the boundary of the district, it shall select
128128 projects and order them in priority. In the area outside the
129129 boundaries of the Metropolitan Planning Organization's the rural
130130 planning organization shall select projects and order them in
131131 priority. If the units of local government have not created a rural
132132 planning organization in accordance with Section 201.6002, the
133133 district shall select projects with the input from county, city and
134134 transportation officials and order them in priority. If the
135135 district selects the projects, the district shall submit them to
136136 the commission for final approval.
137137 (d) The process for developing the plans and programs must
138138 provide for consideration of all modes of transportation and must
139139 be continuing, cooperative, and comprehensive to the degree
140140 appropriate, based on the complexity of the transportation problems
141141 to be addressed.
142142 (e) A planning organization may also prepare and update
143143 periodically a long-range transportation plan for its service area.
144144 The first ten years of the long-range plan shall be identical to the
145145 plan developed in Subsection (c). Before approving a long-range
146146 transportation plan, a planning organization shall provide to
147147 residents within its boundaries, affected public agencies, and
148148 other interested parties a reasonable opportunity to comment on the
149149 long-range transportation plan. A planning organization shall make
150150 each of its long-range transportation plans readily available for
151151 public review and shall deliver each plan to the commission at the
152152 times and in the manner established by the commission.
153153 [(a) The department shall develop a statewide
154154 transportation plan that contains all modes of transportation,
155155 including:
156156 [(1) highways and turnpikes;
157157 [(2) aviation;
158158 [(3) mass transportation;
159159 [(4) railroads and high-speed railroads; and
160160 [(5) water traffic.]
161161 (f[b]) In developing the plan, the planning organization
162162 [department] shall seek opinions and assistance from
163163 transportation officials [other state agencies and political
164164 subdivisions that have responsibility for the modes of
165165 transportation listed by Subsection (a)].
166166 (g) As appropriate, the department and [such} a planning
167167 organization [an agency or political subdivision shall] may enter
168168 into a memorandum of understanding relating to the planning of
169169 transportation services.
170170 (h) The department shall review the plans of the planning
171171 organization to ensure they are in compliance with the requirements
172172 of 23 U.S.C. 135, and provide assistance to the planning
173173 organization to correct deficiencies.
174174 (i[c]) The plan shall be [must include a component that is
175175 not] financially constrained and identify [identifies] all
176176 transportation projects and projects for any other mode of
177177 transportation not included in Section 201.6001(7). [improvements
178178 designed to relieve congestion. In developing this component of
179179 the plan, the department shall seek opinions and assistance from
180180 officials who have local responsibility for modes of transportation
181181 listed in Subsection (a)].
182182 (j) The commission shall adopt rules allowing the regions to
183183 move projects forward or delay projects in the event that there are
184184 additional or fewer funds available than identified in the cash
185185 forecast in subsection (a). Adjustments to the plan should not be
186186 made more than semiannually, unless there are substantial increases
187187 or decreases in available funding.
188188 (k [d]) The plan shall include a component, published
189189 annually, that describes the evaluation of transportation
190190 improvements based on performance measures, such as indices
191191 measuring delay reductions or travel time improvements. The
192192 planning organization [department] shall consider the performance
193193 measures in selecting transportation improvements.
194194 (l) The department shall use the planning organizations'
195195 project lists to create the Statewide Transportation Program and
196196 Budget. The Statewide Transportation Program and Budget shall
197197 include at least the:
198198 (1) department's operating budget,
199199 (2) official cash forecast from Subsection (a),
200200 (3) regions' allocations of funds,
201201 (4) projects selected by the planning organization in
202202 subsection (c), and
203203 (5) work plan, as required by Section 201.621.
204204 (m) The Statewide Transportation Program and Budget shall
205205 be complete and adopted by June 30 of every even numbered year. The
206206 commission shall adopt rules to create a process for planning
207207 organizations to amend the plan from July 1 of every even numbered
208208 year until August 31 of the following odd numbered year. Amendments
209209 to the plan may only reorder projects identified in the same region
210210 subject to Section 201.601(j).
211211 (n) The commission may adopt rules which allow a region to
212212 loan funds to another region at the lending region's discretion in
213213 order to avoid the lapsing of federal appropriations authority.
214214 The rules must allow the lending region to have a senior position
215215 with regards to any future allocated funds of the borrowing region.
216216 The lending region may not charge interest on funds borrowed from
217217 another region that exceed the current bond rate of outstanding
218218 State Highway Fund bonds or in the absence of outstanding debt the
219219 prevailing market rate for comparable municipal debt. The
220220 commission shall post this rate for all districts. A lending region
221221 shall not be penalized in their performance measures if they
222222 successfully negotiate a loan with another region.
223223 (o) The Statewide Transportation Program and Budget shall
224224 be organized first by region, then by mode of transportation
225225 followed by the year of the project. The summary tables of the
226226 report shall summarize the statewide project cost by mode and then
227227 by year. The report shall be made available online in accordance
228228 with Section 201.6013.
229229 SECTION 5. Subchapter H, Chapter 201, Transportation Code,
230230 is amended by adding Sections 201.6012, 201.6013, and 201.6014 to
231231 read as follows:
232232 Sec. 201.6012 TRANSPORTATION ALLOCATION FUNDING FORMULA.
233233 (a) The Commission shall adopt rules creating funding formulas for
234234 transportation projects. In developing the formulas the commission
235235 shall include the input of planning organizations, transportation
236236 officials and local government officials.
237237 (b) All funds received by the department for highways, toll
238238 roads, or toll road systems which provide the state or the
239239 department with discretion shall be allocated by formula to each
240240 region which is based on performance measures and includes at least
241241 the following criteria:
242242 (1) center lane miles,
243243 (2) level of congestion,
244244 (3) percentage of population below federal poverty
245245 level,
246246 (4) population,
247247 (5) safety, and
248248 (5) vehicle miles traveled.
249249 (c) The Commission shall allocate to the regions funding for
250250 the project cost of all transportation projects. The commission
251251 shall adopt various formulas for the different types of
252252 transportation projects. The commission shall adopt rules for all
253253 transportation formulas.
254254 (d) The funds allocated to the region in this section may be
255255 used to:
256256 (1) fund the project cost, provide toll equity, or
257257 make payments under a pass-through toll agreement, for
258258 transportation projects selected by the planning organization;
259259 (2) pay debt service;
260260 (3) repay monies borrowed from another region; or
261261 (4) fund planning organizations' operations in
262262 accordance with Sections 201.6012(f), 201.6012(g), or 201.6012(h).
263263 (e) Revenue from Sections 228.005, 228.0055, and 228.006
264264 shall be allocated in accordance with Transportation Code 228,
265265 Subchapter B. The funds from Chapter 228 shall not be considered
266266 revenue allocated by the formula in Subsection (a).
267267 (f) The allocation of funds shall be encumbered in an amount
268268 equal to the engineer's estimate of the project cost and reduced by
269269 the actual project cost at the time payments associated with the
270270 project are paid.
271271 (g) If a region elects to utilize bond proceeds to advance a
272272 project, the allocation of funds shall be encumbered by the annual
273273 cost of debt service and reduced when debt service payments are
274274 paid.
275275 (h) A metropolitan planning organization operating in a
276276 Metropolitan Management Area as defined by 23 U.S.C 134(k) may
277277 utilize the allocated funds to pay for the operations cost of the
278278 planning organization. The amount that may be allocated to pay for
279279 operations of the planning organization may not exceed the lesser
280280 of $10 million or ten percent of the regions total funds.
281281 (i) A metropolitan planning organization as defined by 23
282282 U.S.C 134(d) may utilize the allocated funds to pay for the
283283 operations cost of the planning organization. The amount that may
284284 be allocated to pay for operations of the planning organization may
285285 not exceed the lesser of $3 million or ten percent of the regions
286286 total funds.
287287 (j) A rural planning organization created under 201.6002
288288 may utilize the allocated funds to pay for the operations cost of
289289 the planning organization. The amount that may be allocated to pay
290290 for operations of the planning organization may not exceed the
291291 lesser of $1 million or ten percent of the regions total funds.
292292 Sec. 201.6013 COMMISSION EMERGENCY AND ECONOMIC
293293 DEVELOPMENT FUNDS (a) Notwithstanding Section 201.601(b) the
294294 commission may choose to set aside an amount of funds not to exceed
295295 the lesser of ten percent of the total funds allocated to the
296296 districts or $250 million annually for the purpose of addressing
297297 emergencies or economic development opportunities that require
298298 transportation infrastructure. The funds may be carried forward
299299 from year to year and may not accumulate to exceed an amount equal
300300 to $1 billion.
301301 (b) If the commission elects to set aside an amount of funds
302302 allowed in subsection (a) then the total amount of funds shall be
303303 reduced by the amount prior to the allocation of funds by the
304304 formula.
305305 (c) The funds shall be encumbered in an amount equal to the
306306 engineer's estimate of the project cost and reduced by the actual
307307 project cost at the time payments associated with the project are
308308 paid.
309309 (d) If the commission elects to utilize bond proceeds to
310310 advance a project, the funds shall be encumbered by the annual cost
311311 of debt service and reduced when debt service payments are paid.
312312 (e) The funds identified in subsection (a) may only be used
313313 to pay cost overruns and change orders of projects selected under
314314 this section.
315315 (f) The commission may only use the funds from subsection
316316 (a) to make payments for projects funded in accordance with Section
317317 222.104 or to provide toll equity if the commission selects the
318318 projects using a competitive project selection process.
319319 Sec. 201.6014 TRANSPORTATION TRANSPARENCY PROGRAM
320320 (a) The department shall develop an interactive web based system
321321 for the tracking of regional allocations and projects. The
322322 planning organizations shall be granted access to the system
323323 through a secure site to input projects and the associated project
324324 costs.
325325 (b) The system shall provide the planning organization with
326326 their allocation of funding for the region and the federal and state
327327 requirements for each source of funding.
328328 (c) The department shall assign a project number to the
329329 project that correlates to the region in which the project is
330330 located.
331331 (d) The department shall develop standardized reports to
332332 assist the district engineers and executive staff in tracking the
333333 efficiency of the project development and to ensure the prudent use
334334 of funds by the region.
335335 (e) The system shall be linked to a publicly accessible
336336 website which enables the tracking of project development and the
337337 expenditure of funds. Each project shall contain a map identifying
338338 the location of the project and a report that identifies the
339339 project, a general scope of work, the allocation of funds
340340 associated with the project, and a current report of expenditures.
341341 (f) The web site shall include mapping of projects by
342342 district to allow easy identification of projects within each
343343 district.
344344 SECTION 6. Subchapter H, Chapter 201, Transportation Code,
345345 is amended by adding Sections 201.621, 201.622, 201.623 to read as
346346 follows:
347347 Sec. 201.621. WORK PLAN. (a) Upon completion of the
348348 ten-year transportation plan in Section 201.601(c), the department
349349 shall utilize the projects listed to develop a proposed ten-year
350350 business work plan. The work plan shall be adopted no later than
351351 August 31 of each even numbered year and include:
352352 (1) a list of projects for which planning, permitting,
353353 design, right-of-way acquisition, or construction work will be
354354 conducted during the period;
355355 (2) the state fiscal quarter in which key milestones
356356 for each project will be completed, including environmental
357357 clearance, completion of final engineering plans, completion of
358358 right-of-way acquisition, letting to contract, and completion of
359359 construction; and
360360 (3) the funding allocated or estimated in each state
361361 fiscal year for each category of work for each project.
362362 (b) In addition to the plan required by Subsection (a) and
363363 other provisions of this chapter, on or before August 31 of each
364364 odd-numbered year, the department shall finalize a project plan for
365365 the time period of September 1 of that odd numbered year until
366366 August 31 of the following odd numbered year. The plan must include
367367 a project schedule with funding for each phase of each project, a
368368 consultant acquisition plan with a schedule for contract
369369 selections, a right-of-way acquisition plan, and a letting plan.
370370 (c) The department shall develop a set of performance
371371 measures for the plan described in Subsection (b) intended to
372372 measure:
373373 (1) the execution of the work program;
374374 (2) the efficiency and cost-effectiveness of its
375375 business practices;
376376 (3) the preservation of the system investment;
377377 (4) the addition of new capacity to the system;
378378 (5) safety initiatives; and
379379 (6) utilization of minority, disadvantaged, and small
380380 businesses.
381381 (d) At a minimum, the performance measures adopted under
382382 Subsection (c) must include:
383383 (1) the percentage of projects for which environmental
384384 clearance is obtained on or before the planned date;
385385 (2) the number of engineering contracts or work orders
386386 executed in contrast with the number planned;
387387 (3) the average time between selection and execution
388388 of a contract for engineering services;
389389 (4) the number of right-of-way parcels acquired and
390390 the number scheduled to be acquired;
391391 (5) the percentage of projects for which right-of-way
392392 acquisition is completed on or before the planned date;
393393 (6) the percentage of parcels acquired through
394394 negotiation;
395395 (7) the percentage of negotiated parcels acquired for
396396 an amount that does not exceed 120 percent of the initial department
397397 offer;
398398 (8) the total amount spent for right-of-way as a
399399 percentage of the original estimated amount;
400400 (9) the number of construction contracts entered into
401401 in contrast with the number planned;
402402 (10) the percentage of construction contracts
403403 executed on or before the planned letting date;
404404 (11) the total amount spent for construction contracts
405405 as a percentage of the original estimated amount;
406406 (12) for all construction contracts completed during
407407 the state fiscal year, the percentage completed within 20 percent
408408 of the original contract time;
409409 (13) for all construction contracts completed during
410410 the state fiscal year, the percentage completed within 10 percent
411411 of the original contract price;
412412 (14) construction contract adjustments as a
413413 percentage of original contract price;
414414 (15) the percentage of bridge structures on the state
415415 highway system that have a rating of good or excellent;
416416 (16) the percentage of bridge structures on the state
417417 highway system that have a posted weight limitation;
418418 (17) the number of bridge repair contracts let in
419419 contrast with the number planned;
420420 (18) the number of bridge replacement contracts let in
421421 contrast with the number planned;
422422 (19) the percentage of lane miles on the state highway
423423 system that have a pavement condition rating of excellent or good;
424424 (20) the number of lane miles on the state highway
425425 system that were resurfaced in contrast with the number planned;
426426 (21) the number of lane miles of capacity improvement
427427 projects let in contrast with the number planned;
428428 (22) of the federal funds subject to forfeiture at the
429429 end of the state fiscal year, the percentage that was committed by
430430 the department;
431431 (23) the amounts of cash receipts and disbursements in
432432 contrast with the forecasted amounts;
433433 (24) the amount spent in connection with contracts
434434 with minority business enterprises as a percentage of the amount
435435 spent on all contracts;
436436 (25) the number of construction contracts let in
437437 contrast with the number let in previous state fiscal years;
438438 (26) the peak hour travel congestion in the seven
439439 largest metropolitan areas in contrast with previous state fiscal
440440 years;
441441 (27) the number of vehicle miles traveled in contrast
442442 with previous state fiscal years; and
443443 (28) the number of lane miles added as a percentage of
444444 the number of previously existing lane miles.
445445 (e) The department shall consult with the legislative
446446 oversight committee on transportation in developing the
447447 performance measures under Subsection (c).
448448 Sec. 201.622. PERFORMANCE REVIEW. Not later than December
449449 1 of each odd-numbered year, the commission shall review the
450450 performance of the department's activities described in Section
451451 201.621(b) and make the review available to the public. The review
452452 must include a report on the level of achievement of each
453453 performance measure listed in Section 201.621(c), statewide and by
454454 department district, and a status report on each major project
455455 under development.
456456 Sec. 201.623. LEGISLATIVE OVERSIGHT COMMITTEE ON
457457 TRANSPORTATION. (a) In this section, "committee" means the
458458 legislative oversight committee on transportation.
459459 (b) The committee is composed of 10 members as follows:
460460 (1) the chair of the Senate Finance Committee;
461461 (2) the chair of the House Appropriations Committee;
462462 (3) the chair of the Senate Transportation and
463463 Homeland Security Committee;
464464 (4) the chair of the House Transportation Committee;
465465 (5) three additional members of the senate appointed
466466 by the lieutenant governor; and
467467 (6) three additional members of the house of
468468 representatives appointed by the speaker of the house of
469469 representatives.
470470 (c) The committee shall monitor:
471471 (1) the implementation of:
472472 (i) the Statewide Transportation Program
473473 and Budget,
474474 (ii) the transportation allocation funding
475475 formula's,
476476 (2) the transportation transparency program;
477477 (3) the development of performance measures under
478478 Section 201.621(c); and
479479 (4) other tasks assigned by the lieutenant governor
480480 and the speaker of the house of representatives.
481481 (d) This section and Section 201.621(e) expire August 31,
482482 2013.
483483 SECTION 7. Subchapter F, Chapter 201, Transportation Code,
484484 is amended by adding Section 201.407 to read as follows:
485485 Sec. 201.407. INSPECTOR GENERAL. (a) The commission shall
486486 appoint an inspector general who reports to the commission.
487487 (b) The inspector general shall:
488488 (1) audit the department's financial condition and the
489489 efficiency of its business practices;
490490 (2) evaluate the efficiency of the department's
491491 administrative practices and performance, including business plan
492492 performance measures, relationships with metropolitan planning
493493 organizations, performance of department districts and offices,
494494 and the need for standardization;
495495 (3) identify the need and opportunities for reductions
496496 in staff and the need for a better or differently skilled workforce;
497497 (4) study the implementation of and improvements to a
498498 commitment-based budget or business plan based on outcomes;
499499 (5) identify ways to streamline the environmental
500500 approval process;
501501 (6) evaluate compliance with applicable laws and
502502 legislative intent; and
503503 (7) evaluate the efficient use of available funding,
504504 personnel, equipment, and office space.
505505 SECTION 8. Section 222.034(b), Transportation Code is
506506 amended to read as follows:
507507 (b) The commission may vary from the distribution procedure
508508 provided by Subsection (a) if it issues a ruling or minute order
509509 identifying the variance and providing a particular justification
510510 for the variance. If the commission intends to vary from the
511511 distribution procedure it shall allocate the funding in accordance
512512 with a formula adopted in Section 201.6012.
513513 SECTION 9. Subchapter D, Chapter 472, Transportation Code,
514514 is amended by adding Section 472.034 to read as follows:
515515 Sec. 472.034 ELIGIBILITY FOR STATE ALLOCATION OF FUNDING;
516516 BOARD MEMBERSHIP (a) In order for a metropolitan planning
517517 organization to be eligible to receive funding from the state for
518518 transportation projects under Section 201.6012, Transportation
519519 Code, the make up of the voting members of the board must include at
520520 least 50 percent elected officials, which are elected within the
521521 boundaries of the metropolitan planning organization.
522522 (b) A metropolitan planning organization which does not
523523 meet the requirements set forth in subsection (a) may redesignate
524524 the board in compliance with the redesignation procedures set forth
525525 in 23 U.S.C. 134, in order to become eligible to receive an
526526 allocation of funding from the state under Section 201.6012,
527527 Transportation Code.
528528 (c) In this section "elected official" is defined as mayor,

531531 SECTION 10. This act takes effect immediately if it
532532 receives a vote of two-thirds of all the members elected to each
533533 house, as provided by Section 30, Article III, Texas Constitution.
534534 If this Act does not receive the vote necessary for immediate
535535 effect, this Act takes effect September 1, 2009.
