| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Subchapter C, Chapter 101, Labor Code, is | |
| 11 | 11 | amended by adding Section 101.1035 to read as follows: | |
| 12 | 12 | Sec. 101.1035. EXCLUSIVE BARGAINING REPRESENTATIVE; METHOD | |
| 13 | 13 | OF ELECTION. (a) In this section, "exclusive bargaining | |
| 14 | 14 | representative" means a labor union selected as the representative | |
| 15 | 15 | of the employees in an appropriate collective bargaining unit to | |
| 16 | 16 | represent the employees in their employment relations with | |
| 17 | 17 | employers. | |
| 18 | 18 | (b) An exclusive bargaining representative must be elected | |
| 19 | 19 | by secret ballot and by majority vote of the employees present and | |
| 20 | 20 | participating, except as provided by Subsection (c). | |
| 21 | 21 | (c) An appropriate collective bargaining unit may take a | |
| 22 | 22 | vote of the entire unit for an exclusive bargaining representative | |
| 23 | 23 | by mailed ballots. | |
| 24 | 24 | SECTION 2. This Act takes effect September 1, 2009. |
