55 relating to the powers of an associate judge in a Title IV-D case.
66 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
77 SECTION 1. Subsection (e), Section 201.104, Family Code, is
88 amended to read as follows:
99 (e) Notwithstanding Subsection (d) and subject to Section
1010 201.1042(g), an associate judge may hear and render an order on:
1111 (1) a suit to modify or clarify an existing child
1212 support order;
1313 (2) a motion to enforce a child support order or revoke
1414 a respondent's community supervision and suspension of commitment;
1515 [or]
1616 (3) a respondent's compliance with the conditions
1717 provided in the associate judge's report for suspension of the
1818 respondent's commitment; or
1919 (4) a motion for postjudgment relief, including a
2020 motion for a new trial or to vacate, correct, or reform a judgment,
2121 if neither party has requested a de novo hearing before the
2222 referring court.
2323 SECTION 2. The change in law made by this Act applies only
2424 to a Title IV-D case referred to an associate judge under Subchapter
2525 B, Chapter 201, Family Code, on or after the effective date of this
2626 Act. A Title IV-D case referred to an associate judge before the
2727 effective date of this Act is governed by the law in effect on the
2828 date the case was referred, and the former law is continued in
2929 effect for that purpose.
3030 SECTION 3. This Act takes effect September 1, 2009.
