| 5 | 5 | | relating to the powers of an associate judge in a Title IV-D case. |

| 6 | 6 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 7 | 7 | | SECTION 1. Subsection (e), Section 201.104, Family Code, is |
|---|
| 8 | 8 | | amended to read as follows: |
|---|
| 9 | 9 | | (e) Notwithstanding Subsection (d) and subject to Section |
|---|
| 10 | 10 | | 201.1042(g), an associate judge may hear and render an order on: |
|---|
| 11 | 11 | | (1) a suit to modify or clarify an existing child |
|---|
| 12 | 12 | | support order; |
|---|
| 13 | 13 | | (2) a motion to enforce a child support order or revoke |
|---|
| 14 | 14 | | a respondent's community supervision and suspension of commitment; |
|---|
| 15 | 15 | | [or] |
|---|
| 16 | 16 | | (3) a respondent's compliance with the conditions |
|---|
| 17 | 17 | | provided in the associate judge's report for suspension of the |
|---|
| 18 | 18 | | respondent's commitment; or |
|---|
| 19 | 19 | | (4) a motion for postjudgment relief, including a |
|---|
| 20 | 20 | | motion for a new trial or to vacate, correct, or reform a judgment, |
|---|
| 21 | 21 | | if neither party has requested a de novo hearing before the |
|---|
| 22 | 22 | | referring court. |

| 23 | 23 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 24 | 24 | | to a Title IV-D case referred to an associate judge under Subchapter |
|---|
| 25 | 25 | | B, Chapter 201, Family Code, on or after the effective date of this |
|---|
| 26 | 26 | | Act. A Title IV-D case referred to an associate judge before the |
|---|
| 27 | 27 | | effective date of this Act is governed by the law in effect on the |
|---|
| 28 | 28 | | date the case was referred, and the former law is continued in |
|---|
| 29 | 29 | | effect for that purpose. |
|---|
| 30 | 30 | | SECTION 3. This Act takes effect September 1, 2009. |
