55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to compliance requirements for candidates for judicial
88 office.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 34.001(a), Government Code, is amended
1111 to read as follows:
1212 (a) A person who has filed an application for a place on the
1313 ballot as provided by the Election Code for a judicial office listed
1414 in Subsection (b) is subject to Canon 5 [7], Code of Judicial
1515 Conduct, and is subject to sanctions as provided by this chapter.
1616 SECTION 2. Section 34.003, Government Code, is amended to
1717 read as follows:
1818 Sec. 34.003. ATTORNEY. A candidate who is an attorney and
1919 who violates Canon 5 [7], Code of Judicial Conduct, or any other
2020 relevant provision of that code is subject to sanctions by the state
2121 bar.
2222 SECTION 3. Section 34.004, Government Code, is amended to
2323 read as follows:
2424 Sec. 34.004. OTHER CANDIDATE. A candidate other than a
2525 judge under Section 34.002 or an attorney under Section 34.003 who
2626 violates Canon 5 [7], Code of Judicial Conduct, or any other
2727 relevant provision of that code is subject to review by the attorney
2828 general or the local district attorney for appropriate disciplinary
2929 action.
3030 SECTION 4. This Act takes effect immediately if it receives
3131 a vote of two-thirds of all the members elected to each house, as
3232 provided by Section 39, Article III, Texas Constitution. If this
3333 Act does not receive the vote necessary for immediate effect, this
3434 Act takes effect September 1, 2009.
