9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 34.001(a), Government Code, is amended |
---|
11 | 11 | | to read as follows: |
---|
12 | 12 | | (a) A person who has filed an application for a place on the |
---|
13 | 13 | | ballot as provided by the Election Code for a judicial office listed |
---|
14 | 14 | | in Subsection (b) is subject to Canon 5 [7], Code of Judicial |
---|
15 | 15 | | Conduct, and is subject to sanctions as provided by this chapter. |
---|
16 | 16 | | SECTION 2. Section 34.003, Government Code, is amended to |
---|
17 | 17 | | read as follows: |
---|
18 | 18 | | Sec. 34.003. ATTORNEY. A candidate who is an attorney and |
---|
19 | 19 | | who violates Canon 5 [7], Code of Judicial Conduct, or any other |
---|
20 | 20 | | relevant provision of that code is subject to sanctions by the state |
---|
21 | 21 | | bar. |
---|
22 | 22 | | SECTION 3. Section 34.004, Government Code, is amended to |
---|
23 | 23 | | read as follows: |
---|
24 | 24 | | Sec. 34.004. OTHER CANDIDATE. A candidate other than a |
---|
25 | 25 | | judge under Section 34.002 or an attorney under Section 34.003 who |
---|
26 | 26 | | violates Canon 5 [7], Code of Judicial Conduct, or any other |
---|
27 | 27 | | relevant provision of that code is subject to review by the attorney |
---|
28 | 28 | | general or the local district attorney for appropriate disciplinary |
---|
29 | 29 | | action. |
---|
30 | 30 | | SECTION 4. This Act takes effect immediately if it receives |
---|
31 | 31 | | a vote of two-thirds of all the members elected to each house, as |
---|
32 | 32 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
33 | 33 | | Act does not receive the vote necessary for immediate effect, this |
---|
34 | 34 | | Act takes effect September 1, 2009. |
