| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter C, Chapter 39, Utilities Code, is |
|---|
| 11 | 11 | | amended by adding Section 39.112 to read as follows: |
|---|
| 12 | 12 | | Sec. 39.112. NOTICE OF EXPIRATION AND PRICE CHANGE. (a) In |
|---|
| 13 | 13 | | this section, "fixed price contract" means a residential retail |
|---|
| 14 | 14 | | electric service contract for which the price per kilowatt hour is |
|---|
| 15 | 15 | | stated in the contract and does not change throughout the term of |
|---|
| 16 | 16 | | the contract. The term does not include month-to-month service. |
|---|
| 17 | 17 | | (b) A retail electric provider shall provide a residential |
|---|
| 18 | 18 | | customer who has a fixed price contract with written notification |
|---|
| 19 | 19 | | of the date the fixed price contract is scheduled to expire, the |
|---|
| 20 | 20 | | date the price is scheduled to change, if applicable, and the amount |
|---|
| 21 | 21 | | of the price change. The notice must: |
|---|
| 22 | 22 | | (1) be sent to the customer's billing address by mail |
|---|
| 23 | 23 | | postmarked not less than 60 days before the date the price is |
|---|
| 24 | 24 | | scheduled to change; |
|---|
| 25 | 25 | | (2) be sent to the customer's e-mail address, if |
|---|
| 26 | 26 | | available to the provider, not less than 60 days before the date the |
|---|
| 27 | 27 | | price is scheduled to change; and |
|---|
| 28 | 28 | | (3) include a statement that reads: "You may shop for |
|---|
| 29 | 29 | | electricity providers at http://www.powertochoose.org." |
|---|
| 30 | 30 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 31 | 31 | | to a contract for retail electric service entered into or renewed on |
|---|
| 32 | 32 | | or after the effective date of this Act. A contract for retail |
|---|
| 33 | 33 | | electric service entered into or renewed before the effective date |
|---|
| 34 | 34 | | of this Act is governed by the law as it existed immediately before |
|---|
| 35 | 35 | | the effective date of this Act, and that law is continued in effect |
|---|
| 36 | 36 | | for that purpose. |
|---|
| 37 | 37 | | SECTION 3. This Act takes effect September 1, 2009. |
