| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 281.050, Health and Safety Code, is |
|---|
| 9 | 9 | | amended to read as follows: |
|---|
| 10 | 10 | | Sec. 281.050. POWERS RELATING TO DISTRICT PROPERTY, |
|---|
| 11 | 11 | | FACILITIES, AND EQUIPMENT. (a) With the approval of the |
|---|
| 12 | 12 | | commissioners court, the board may construct, condemn, acquire, |
|---|
| 13 | 13 | | lease, add to, maintain, operate, develop, regulate, sell, |
|---|
| 14 | 14 | | exchange, and convey any property, property right, equipment, |
|---|
| 15 | 15 | | hospital facility, or system to maintain a hospital, building, or |
|---|
| 16 | 16 | | other facility or to provide a service required by the district. |
|---|
| 17 | 17 | | Approval of the commissioners court shall be required for the sale |
|---|
| 18 | 18 | | or lease of a hospital facility regardless of the provisions of |
|---|
| 19 | 19 | | Section 285.051. |
|---|
| 20 | 20 | | (b) Notwithstanding any other law, the board may, with the |
|---|
| 21 | 21 | | approval of the commissioners court, lease undeveloped real |
|---|
| 22 | 22 | | property for not more than 50 years to provide for the development |
|---|
| 23 | 23 | | and construction of facilities designed to generate revenue for the |
|---|
| 24 | 24 | | financial benefit of the district. The board, directly or through a |
|---|
| 25 | 25 | | nonprofit corporation, may contract or enter into a joint venture |
|---|
| 26 | 26 | | with a public or private entity as necessary to enter into a lease |
|---|
| 27 | 27 | | under this subsection. |
|---|
| 28 | 28 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 29 | 29 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 30 | 30 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 31 | 31 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 32 | 32 | | Act takes effect September 1, 2009. |
