77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 281.050, Health and Safety Code, is
99 amended to read as follows:
1010 Sec. 281.050. POWERS RELATING TO DISTRICT PROPERTY,
1111 FACILITIES, AND EQUIPMENT. (a) With the approval of the
1212 commissioners court, the board may construct, condemn, acquire,
1313 lease, add to, maintain, operate, develop, regulate, sell,
1414 exchange, and convey any property, property right, equipment,
1515 hospital facility, or system to maintain a hospital, building, or
1616 other facility or to provide a service required by the district.
1717 Approval of the commissioners court shall be required for the sale
1818 or lease of a hospital facility regardless of the provisions of
1919 Section 285.051.
2020 (b) Notwithstanding any other law, the board may, with the
2121 approval of the commissioners court, lease undeveloped real
2222 property for not more than 50 years to provide for the development
2323 and construction of facilities designed to generate revenue for the
2424 financial benefit of the district. The board, directly or through a
2525 nonprofit corporation, may contract or enter into a joint venture
2626 with a public or private entity as necessary to enter into a lease
2727 under this subsection.
2828 SECTION 2. This Act takes effect immediately if it receives
2929 a vote of two-thirds of all the members elected to each house, as
3030 provided by Section 39, Article III, Texas Constitution. If this
3131 Act does not receive the vote necessary for immediate effect, this
3232 Act takes effect September 1, 2009.
