55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a grant available to school districts to provide
88 services to students with disabilities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 29, Education Code, is
1111 amended by adding Section 29.018 to read as follows:
1212 Sec. 29.018. SPECIAL EDUCATION GRANT. (a) From funds
1313 appropriated for the purposes of this section, federal funds, or
1414 any other funds available, the commissioner shall make grants
1515 available to school districts to assist districts in covering the
1616 cost of educating students with disabilities.
1717 (b) A school district is eligible to apply for a grant under
1818 this section if:
1919 (1) the district does not receive sufficient funds
2020 under Section 42.151 for a student with disabilities to pay for the
2121 services provided to the student; or
2222 (2) the district does not receive sufficient funds
2323 under Section 42.151 for all students with disabilities in the
2424 district to pay for the services provided to the students.
2525 (c) A school district that applies for a grant under this
2626 section must provide the commissioner with a report comparing the
2727 state funds received by the district for students with disabilities
2828 and the expenses incurred by the district in providing services to
2929 students with disabilities.
3030 (d) Expenses that may be included by a school district in
3131 applying for a grant under this section include the cost of training
3232 personnel to provide services to a student with disabilities.
3333 (e) A school district that receives a grant under this
3434 section must educate students with disabilities in the least
3535 restrictive environment that is appropriate to meet the student's
3636 educational needs.
3737 (f) The commissioner shall adopt rules as necessary to
3838 administer this section.
3939 SECTION 2. This Act applies beginning with the 2009-2010
4040 school year.
4141 SECTION 3. This Act takes effect September 1, 2009.
