6 | 6 | | relating to the eligibility of nonprofit organizations that partner |

7 | 7 | | with certain schools to receive grants for agricultural projects. |

8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Section 48.001, Agriculture Code, is amended to |
---|
10 | 10 | | read as follows: |
---|
11 | 11 | | Sec. 48.001. CREATION. (a) Consistent with this chapter, |
---|
12 | 12 | | the department by rule shall develop a program to award grants to |
---|
13 | 13 | | public elementary and middle schools located in large urban school |
---|
14 | 14 | | districts for the purpose of establishing: |
---|
15 | 15 | | (1) demonstration agricultural projects; or |
---|
16 | 16 | | (2) other projects designed to foster an understanding |
---|
17 | 17 | | and awareness of agriculture. |
---|
18 | 18 | | (b) The department may award a grant under Subsection (a) to |
---|
19 | 19 | | a nonprofit organization that partners with a school described by |
---|
20 | 20 | | Subsection (a) to establish a project described by Subsection (a) |
---|
21 | 21 | | at the school. |
---|
22 | 22 | | SECTION 2. Section 48.002, Agriculture Code, is amended to |
---|
23 | 23 | | read as follows: |
---|
24 | 24 | | Sec. 48.002. ELIGIBILITY. Subject to available funds, a |
---|
25 | 25 | | public elementary or middle school, or a nonprofit organization |
---|
26 | 26 | | that partners with the school, is eligible to receive a grant under |
---|
27 | 27 | | this chapter if the school: |
---|
28 | 28 | | (1) is located in a school district with an enrollment |
---|
29 | 29 | | of at least 49,000 students; and |
---|
30 | 30 | | (2) submits to the department, at the time and in the |
---|
31 | 31 | | form required by the department, a proposal for a demonstration |
---|
32 | 32 | | agricultural project that includes: |
---|
33 | 33 | | (A) a description of the proposed project; |
---|
34 | 34 | | (B) a schedule of projected costs for the |
---|
35 | 35 | | project; [and] |
---|
36 | 36 | | (C) a statement of the educational benefits of |
---|
37 | 37 | | the project, including how the project will improve understanding |
---|
38 | 38 | | of agriculture; and |
---|
39 | 39 | | (D) if a nonprofit organization is applying for |
---|
40 | 40 | | the grant, a statement from the school that the nonprofit |
---|
41 | 41 | | organization is partnering with the school. |
---|
42 | 42 | | SECTION 3. Section 48.004, Agriculture Code, is amended to |
---|
43 | 43 | | read as follows: |
---|
44 | 44 | | Sec. 48.004. REPORT. A school or nonprofit organization |
---|
45 | 45 | | that receives a grant under this chapter must report the results of |
---|
46 | 46 | | the project to the department in a manner determined by the |
---|
47 | 47 | | department. |
---|
48 | 48 | | SECTION 4. Section 48.003, Agriculture Code, is repealed. |
---|
49 | 49 | | SECTION 5. This Act takes effect immediately if it receives |
---|
50 | 50 | | a vote of two-thirds of all the members elected to each house, as |
---|
51 | 51 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
52 | 52 | | Act does not receive the vote necessary for immediate effect, this |
---|
53 | 53 | | Act takes effect September 1, 2009. |
