55 AN ACT
66 relating to the eligibility of nonprofit organizations that partner
77 with certain schools to receive grants for agricultural projects.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 48.001, Agriculture Code, is amended to
1010 read as follows:
1111 Sec. 48.001. CREATION. (a) Consistent with this chapter,
1212 the department by rule shall develop a program to award grants to
1313 public elementary and middle schools located in large urban school
1414 districts for the purpose of establishing:
1515 (1) demonstration agricultural projects; or
1616 (2) other projects designed to foster an understanding
1717 and awareness of agriculture.
1818 (b) The department may award a grant under Subsection (a) to
1919 a nonprofit organization that partners with a school described by
2020 Subsection (a) to establish a project described by Subsection (a)
2121 at the school.
2222 SECTION 2. Section 48.002, Agriculture Code, is amended to
2323 read as follows:
2424 Sec. 48.002. ELIGIBILITY. Subject to available funds, a
2525 public elementary or middle school, or a nonprofit organization
2626 that partners with the school, is eligible to receive a grant under
2727 this chapter if the school:
2828 (1) is located in a school district with an enrollment
2929 of at least 49,000 students; and
3030 (2) submits to the department, at the time and in the
3131 form required by the department, a proposal for a demonstration
3232 agricultural project that includes:
3333 (A) a description of the proposed project;
3434 (B) a schedule of projected costs for the
3535 project; [and]
3636 (C) a statement of the educational benefits of
3737 the project, including how the project will improve understanding
3838 of agriculture; and
3939 (D) if a nonprofit organization is applying for
4040 the grant, a statement from the school that the nonprofit
4141 organization is partnering with the school.
4242 SECTION 3. Section 48.004, Agriculture Code, is amended to
4343 read as follows:
4444 Sec. 48.004. REPORT. A school or nonprofit organization
4545 that receives a grant under this chapter must report the results of
4646 the project to the department in a manner determined by the
4747 department.
4848 SECTION 4. Section 48.003, Agriculture Code, is repealed.
4949 SECTION 5. This Act takes effect immediately if it receives
5050 a vote of two-thirds of all the members elected to each house, as
5151 provided by Section 39, Article III, Texas Constitution. If this
5252 Act does not receive the vote necessary for immediate effect, this
5353 Act takes effect September 1, 2009.
