55 relating to the composition, administration, and duties, including
66 reporting requirements, of the Border Health Institute.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Subsection (b), Section 151.002, Education Code,
99 is amended to read as follows:
1010 (b) The institute shall operate in a manner that facilitates
1111 and assists the activities of international, national, regional, or
1212 local health-related institutions working in the Texas-Mexico
1313 border region [to:
1414 [(1) create and fund centers or component units within
1515 the institute to facilitate research in fields of study affecting
1616 public health in the border region, including research related to
1717 diabetes, Hispanic health issues, infectious diseases, emerging
1818 infections, environmental health issues, and children's health
1919 issues;
2020 [(2) deliver health care or provide health education
2121 to persons living in the border region; and
2222 [(3) conduct and facilitate research in fields of
2323 study affecting public health in the border region, including
2424 research related to diabetes, Hispanic health issues, infectious
2525 diseases, emerging infections, environmental health issues, and
2626 children's health issues].
2727 SECTION 2. Subsection (a), Section 151.003, Education Code,
2828 is amended to read as follows:
2929 (a) Subject to Subsection (b), the [The] institute is
3030 [initially] composed of the following institutions:
3131 (1) The University of Texas at El Paso;
3232 (2) Texas Tech University Health Sciences Center at El
3333 Paso;
3434 (3) El Paso Community College District;
3535 (4) R. E. Thomason General Hospital;
3636 (5) El Paso City/County Health District;
3737 (6) Department of State Health Services; and
3838 (7) Medical Center of the Americas Foundation [The
3939 University of Texas Health Science Center at Houston, School of
4040 Public Health;
4141 [(7) El Paso County Medical Society;
4242 [(8) Paso del Norte Health Foundation; and
4343 [(9) the Texas Department of Health].
4444 SECTION 3. Section 151.008, Education Code, is amended to
4545 read as follows:
4646 Sec. 151.008. BIENNIAL [ANNUAL] REPORTING. (a) Not later
4747 than December 1 of each even-numbered [Each] year, each member of
4848 the institute shall provide a long-term strategic plan for that
4949 member to:
5050 (1) each member of the governing board of the
5151 institute;
5252 (2) [and to] each member of the legislature whose
5353 district includes any portion of a county where the Border Health
5454 Institute is established or operating; and
5555 (3) the Texas Higher Education Coordinating Board [an
5656 annual audited financial statement and a status report of each
5757 project undertaken by the institute].
5858 (b) The long-term strategic plan for each member must
5959 include a statement of the member's goals and objectives for:
6060 (1) providing health care services to persons living
6161 in the border region;
6262 (2) providing health care education to persons living
6363 in the border region; and
6464 (3) conducting research into issues affecting public
6565 health in the border region, including research related to:
6666 (A) diabetes;
6767 (B) health issues of particular concern to
6868 persons of Hispanic descent;
6969 (C) infectious diseases;
7070 (D) emerging infections;
7171 (E) trauma care;
7272 (F) environmental health; and
7373 (G) children's health.
7474 SECTION 4. Subsection (d), Section 151.004, and Sections
7575 151.006, 151.007, and 151.010, Education Code, are repealed.
7676 SECTION 5. This Act takes effect immediately if it receives
7777 a vote of two-thirds of all the members elected to each house, as
7878 provided by Section 39, Article III, Texas Constitution. If this
7979 Act does not receive the vote necessary for immediate effect, this
8080 Act takes effect September 1, 2009.
