66 AN ACT
77 relating to the portion of designated tuition required to be set
88 aside to provide student financial assistance at institutions of
99 higher education.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 56.011(a), Education Code, is amended to
1212 read as follows:
1313 (a) The governing board of each institution of higher
1414 education shall cause to be set aside not less than 20 percent of
1515 any amount of tuition charged to a resident undergraduate student
1616 under Section 54.0513 in excess of $46 per semester credit hour.
1717 The funds set aside under this section by an institution shall be
1818 used to provide need-based financial assistance for resident
1919 undergraduate students enrolled in the institution.
2020 SECTION 2. Section 56.012(a), Education Code, is amended to
2121 read as follows:
2222 (a) The governing board of each institution of higher
2323 education shall cause to be set aside not less than 15 percent of
2424 any amount of tuition charged to a resident student enrolled in a
2525 graduate or professional degree program under Section 54.0513 in
2626 excess of $46 per semester credit hour. The funds set aside under
2727 this section by an institution shall be used to provide need-based
2828 financial assistance for resident students enrolled in graduate and
2929 professional degree programs at the institution.
3030 SECTION 3. Section 56.465(a), Education Code, is amended to
3131 read as follows:
3232 (a) The governing board of each institution of higher
3333 education shall cause to be set aside five percent of the amount of
3434 the tuition charged to a resident undergraduate student at the
3535 institution under Section 54.0513 in excess of $46 per semester
3636 credit hour. The amount of a student's tuition set aside under this
3737 subsection is in addition to [considered a part of] the amount
3838 required to be set aside from that tuition under Section 56.011.
3939 SECTION 4. (a) The change in law made by this Act to
4040 Sections 56.011 and 56.012, Education Code, applies only to
4141 financial aid awarded for a semester or term that begins on or after
4242 the effective date of this Act, and does not affect a student's
4343 right to receive financial aid awarded before the effective date of
4444 this Act for any part of the 2009-2010 academic year.
4545 (b) The change in law made by this Act to Section 56.465,
4646 Education Code, applies beginning with tuition paid for the
4747 2009-2010 academic year. The change in law does not affect the
4848 amount of tuition set aside under that section for an academic
4949 period before the 2009-2010 academic year, and the former law is
5050 continued in effect for that purpose.
5151 SECTION 5. This Act takes effect September 1, 2009.
