7 | 7 | | relating to the portion of designated tuition required to be set |

8 | 8 | | aside to provide student financial assistance at institutions of |
---|
9 | 9 | | higher education. |

10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Section 56.011(a), Education Code, is amended to |
---|
12 | 12 | | read as follows: |
---|
13 | 13 | | (a) The governing board of each institution of higher |
---|
14 | 14 | | education shall cause to be set aside not less than 20 percent of |
---|
15 | 15 | | any amount of tuition charged to a resident undergraduate student |
---|
16 | 16 | | under Section 54.0513 in excess of $46 per semester credit hour. |
---|
17 | 17 | | The funds set aside under this section by an institution shall be |
---|
18 | 18 | | used to provide need-based financial assistance for resident |
---|
19 | 19 | | undergraduate students enrolled in the institution. |
---|
20 | 20 | | SECTION 2. Section 56.012(a), Education Code, is amended to |
---|
21 | 21 | | read as follows: |
---|
22 | 22 | | (a) The governing board of each institution of higher |
---|
23 | 23 | | education shall cause to be set aside not less than 15 percent of |
---|
24 | 24 | | any amount of tuition charged to a resident student enrolled in a |
---|
25 | 25 | | graduate or professional degree program under Section 54.0513 in |
---|
26 | 26 | | excess of $46 per semester credit hour. The funds set aside under |
---|
27 | 27 | | this section by an institution shall be used to provide need-based |
---|
28 | 28 | | financial assistance for resident students enrolled in graduate and |
---|
29 | 29 | | professional degree programs at the institution. |
---|
30 | 30 | | SECTION 3. Section 56.465(a), Education Code, is amended to |
---|
31 | 31 | | read as follows: |
---|
32 | 32 | | (a) The governing board of each institution of higher |
---|
33 | 33 | | education shall cause to be set aside five percent of the amount of |
---|
34 | 34 | | the tuition charged to a resident undergraduate student at the |
---|
35 | 35 | | institution under Section 54.0513 in excess of $46 per semester |
---|
36 | 36 | | credit hour. The amount of a student's tuition set aside under this |
---|
37 | 37 | | subsection is in addition to [considered a part of] the amount |
---|
38 | 38 | | required to be set aside from that tuition under Section 56.011. |
---|
39 | 39 | | SECTION 4. (a) The change in law made by this Act to |
---|
40 | 40 | | Sections 56.011 and 56.012, Education Code, applies only to |
---|
41 | 41 | | financial aid awarded for a semester or term that begins on or after |
---|
42 | 42 | | the effective date of this Act, and does not affect a student's |
---|
43 | 43 | | right to receive financial aid awarded before the effective date of |
---|
44 | 44 | | this Act for any part of the 2009-2010 academic year. |
---|
45 | 45 | | (b) The change in law made by this Act to Section 56.465, |
---|
46 | 46 | | Education Code, applies beginning with tuition paid for the |
---|
47 | 47 | | 2009-2010 academic year. The change in law does not affect the |
---|
48 | 48 | | amount of tuition set aside under that section for an academic |
---|
49 | 49 | | period before the 2009-2010 academic year, and the former law is |
---|
50 | 50 | | continued in effect for that purpose. |
---|
51 | 51 | | SECTION 5. This Act takes effect September 1, 2009. |
