66 AN ACT
77 relating to the promotion and marketing of alcoholic beverages.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 62.01, Alcoholic Beverage Code, is
1010 amended by adding Subsection (c) to read as follows:
1111 (c) A manufacturer who holds a sampling event at a
1212 retailer's premises:
1313 (1) must notify the distributor in whose territory the
1414 retail premises is located of the event at least 48 hours before the
1515 event is scheduled to begin; and
1616 (2) may charge the distributor not more than 50
1717 percent of the cost of the event.
1818 SECTION 2. Section 64.01, Alcoholic Beverage Code, is
1919 amended by adding Subsection (c) to read as follows:
2020 (c) The holder of a general distributor's license may
2121 conduct samplings of beer, including tastings, at a retailer's
2222 premises. An agent or employee of the holder of a general
2323 distributor's license may open, touch, or pour beer, make a
2424 presentation, or answer questions at a sampling event.
2525 SECTION 3. Section 65.01, Alcoholic Beverage Code, is
2626 amended by adding Subsection (c) to read as follows:
2727 (c) The holder of a local distributor's license may conduct
2828 samplings of beer, including tastings, at a retailer's premises.
2929 An agent or employee of the holder of a local distributor's license
3030 may open, touch, or pour beer, make a presentation, or answer
3131 questions at a sampling event.
3232 SECTION 4. Chapter 108, Alcoholic Beverage Code, is amended
3333 by adding Subchapter D to read as follows:
3434 SUBCHAPTER D. PROMOTIONAL EVENTS
3535 Sec. 108.101. CONSUMER PRODUCT INSTRUCTION EVENTS. (a) In
3636 this section, "consumer product instruction event" means a
3737 prescheduled event during which the license or permit holder
3838 provides consumers of legal drinking age with one or more malt
3939 beverages the sale of which is authorized in this state for the
4040 purposes of providing consumer instruction on the history, quality,
4141 characteristics, presentation, or serving of the beverages
4242 provided and allowing consumers to taste the beverages provided.
4343 (b) Notwithstanding Section 102.07, 102.14, 102.15, or
4444 108.06, or any other provision of this code, a holder of a
4545 manufacturer's license, nonresident manufacturer's license,
4646 brewer's permit, nonresident brewer's permit, nonresident seller's
4747 permit, general distributor's license, local distributor's
4848 license, wholesaler's permit, Class B wholesaler's permit, agent's
4949 beer license, agent's permit, manufacturer's agent's permit, or
5050 promotional permit, or the license or permit holder's agent,
5151 representative, or employee, may, in order to promote the license
5252 or permit holder's malt beverages, conduct consumer product
5353 instruction events at the premises of a retailer holding a license
5454 or permit to sell alcoholic beverages for on-premises or
5555 off-premises consumption.
5656 (c) A consumer product instruction event must be conducted
5757 during normal business hours, if conducted on a licensed or
5858 permitted premises, and may not exceed three hours in length.
5959 (d) The license or permit holder conducting a consumer
6060 product instruction event may open, touch, pour, and serve malt
6161 beverages.
6262 (e) The license or permit holder conducting the consumer
6363 product instruction event must purchase all malt beverages used in
6464 the event from the retailer. The retailer may not charge the
6565 license or permit holder more than the price the retailer charges a
6666 consumer for the beverages.
6767 (f) A consumer product instruction event may be prearranged
6868 with and preannounced to a retailer. A consumer product
6969 instruction event may not be preannounced to a consumer.
7070 Sec. 108.102. EXPERIENTIAL DINNERS. (a) In this section,
7171 "experiential dinner" means a prescheduled and private event during
7272 which invited consumers and alcoholic beverage retailer employees
7373 of legal drinking age are provided with an opportunity to attend a
7474 dinner for the purpose of:
7575 (1) receiving instruction on pairing malt beverages
7676 with food and the history, quality, characteristics, presentation,
7777 and service of malt beverages;
7878 (2) receiving and tasting malt beverages authorized
7979 for sale in this state; and
8080 (3) receiving entertainment.
8181 (b) Notwithstanding Section 102.07, 102.14, 102.15, or
8282 108.06, or any other provision of this code, a holder of a
8383 manufacturer's license, nonresident manufacturer's license,
8484 brewer's permit, nonresident brewer's permit, nonresident seller's
8585 permit, general distributor's license, local distributor's
8686 license, wholesaler's permit, Class B wholesaler's permit, agent's
8787 beer license, agent's permit, manufacturer's agent's permit, or
8888 promotional permit, or the license or permit holder's agent,
8989 representative, or employee, or any retailer licensed or permitted
9090 for on-premises consumption, may, in order to promote the license
9191 or permit holder's malt beverages, conduct an experiential dinner
9292 at the premises of a retailer holding a license or permit to sell
9393 alcoholic beverages for on-premises consumption.
9494 (c) An experiential dinner must be conducted during normal
9595 business hours, if conducted on a licensed or permitted premises,
9696 and may not exceed five hours in length.
9797 (d) The license or permit holder conducting the instruction
9898 and tasting may open, touch, pour, and serve malt beverages.
9999 (e) The license or permit holder conducting the
100100 experiential dinner must purchase all malt beverages and food used
101101 in the event from the retailer. The retailer may not charge the
102102 license or permit holder more than the price the retailer charges a
103103 consumer for the beverages.
104104 (f) An experiential dinner may be prearranged with,
105105 preannounced to, or conducted jointly with a retailer and the
106106 retailer's employees.
107107 (g) Consumers may be invited to an experiential dinner
108108 through a sweepstakes or any other method chosen by the license or
109109 permit holder conducting the experiential dinner.
110110 (h) The license or permit holder conducting the
111111 experiential dinner may preannounce and advertise the experiential
112112 dinner to consumers. The retailer or the retailer's location may
113113 not be mentioned in that advertising, except that invitees may be
114114 informed of the retail location in an official invitation.
115115 (i) The value of the food, beverages, and entertainment
116116 provided during the experiential dinner may not exceed $150 per
117117 person on any one occasion.
118118 Sec. 108.103. SWEEPSTAKES PRIZE EVENTS. (a) Nothing in
119119 this chapter or this code prohibits a license or permit holder
120120 listed in Section 102.07(a) or a holder of a manufacturer's or
121121 nonresident manufacturer's license or permit or the license or
122122 permit holder's agent, representative, or employee from:
123123 (1) conducting a sweepstakes in which the prize is a
124124 private, promotional event held at the premises of a retailer
125125 holding a license or permit to sell alcoholic beverages for
126126 on-premises consumption for consumer winners and other invited
127127 guests of legal drinking age, including distributors and retailers
128128 and employees of distributors and retailers; and
129129 (2) providing food, beverages, entertainment, and
130130 recreation to the attendees of the event.
131131 (b) The retailer or the retailer's location may not be
132132 mentioned in any advertising for the sweepstakes, except that
133133 invitees may be informed of the retail location in an official
134134 invitation.
135135 Sec. 108.104. PREANNOUNCEMENT OF PROMOTIONAL EVENTS AT
136136 RETAILER PREMISES. Notwithstanding Section 102.15 or any other
137137 provision of this code, a manufacturer or distributor may
138138 prearrange with or preannounce to a retailer a promotional activity
139139 otherwise authorized by this code that is to be held on the
140140 retailer's premises. The promotional activity may not be
141141 preannounced to a consumer.
142142 SECTION 5. This Act takes effect September 1, 2009.
