9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Subchapter Z, Chapter 51, Education Code, is |
---|
11 | 11 | | amended by adding Section 51.9481 to read as follows: |
---|
12 | 12 | | Sec. 51.9481. REQUIRED PERFORMANCE REVIEW OF CHIEF |
---|
13 | 13 | | EXECUTIVE OFFICER OF INSTITUTION. (a) In this section, |
---|
14 | 14 | | "institution of higher education" has the meaning assigned by |
---|
15 | 15 | | Section 61.003. |
---|
16 | 16 | | (b) The employment contract of the president or other chief |
---|
17 | 17 | | executive officer of an institution of higher education must |
---|
18 | 18 | | provide for an annual evaluation of the president's or other |
---|
19 | 19 | | officer's performance. The evaluation must include consideration |
---|
20 | 20 | | of the following performance measures: |
---|
21 | 21 | | (1) development and encouragement of institutional |
---|
22 | 22 | | efforts to improve student retention and graduation rates; |
---|
23 | 23 | | (2) effective use and allocation of resources, |
---|
24 | 24 | | including faculty, staff, facilities, equipment, and financial |
---|
25 | 25 | | resources, to carry out the institution's mission and purposes; |
---|
26 | 26 | | (3) effective planning and budgeting to implement the |
---|
27 | 27 | | institution's objectives; |
---|
28 | 28 | | (4) efforts to ensure the academic quality and |
---|
29 | 29 | | soundness of the activities of faculty and students; |
---|
30 | 30 | | (5) clear and effective leadership consistent with the |
---|
31 | 31 | | policies and decisions of the governing body of the institution; |
---|
32 | 32 | | (6) understanding of the different missions and |
---|
33 | 33 | | purposes among the academic divisions and programs of the |
---|
34 | 34 | | institution; |
---|
35 | 35 | | (7) effective recruitment and retention of capable and |
---|
36 | 36 | | recognized faculty; |
---|
37 | 37 | | (8) efforts to improve the quality of the |
---|
38 | 38 | | institution's academic programs, including obtaining professional |
---|
39 | 39 | | accreditation; |
---|
40 | 40 | | (9) effective human relations skills with |
---|
41 | 41 | | subordinates, alumni, the community, business and community |
---|
42 | 42 | | leaders, legislators and other state and local officials, and other |
---|
43 | 43 | | persons associated with the institution; and |
---|
44 | 44 | | (10) excellence in public relations within the |
---|
45 | 45 | | institution and with persons outside the institution. |
---|
46 | 46 | | SECTION 2. Section 51.9481, Education Code, as added by |
---|
47 | 47 | | this Act, applies only to an employment contract entered into or |
---|
48 | 48 | | renewed by the governing board of a public institution of higher |
---|
49 | 49 | | education with the chief executive officer of the institution on or |
---|
50 | 50 | | after the effective date of this Act. |
---|
51 | 51 | | SECTION 3. This Act takes effect September 1, 2009. |
