55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to contracts entered into for the employment of the chief
88 executive officer of a public institution of higher education.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter Z, Chapter 51, Education Code, is
1111 amended by adding Section 51.9481 to read as follows:
1212 Sec. 51.9481. REQUIRED PERFORMANCE REVIEW OF CHIEF
1313 EXECUTIVE OFFICER OF INSTITUTION. (a) In this section,
1414 "institution of higher education" has the meaning assigned by
1515 Section 61.003.
1616 (b) The employment contract of the president or other chief
1717 executive officer of an institution of higher education must
1818 provide for an annual evaluation of the president's or other
1919 officer's performance. The evaluation must include consideration
2020 of the following performance measures:
2121 (1) development and encouragement of institutional
2222 efforts to improve student retention and graduation rates;
2323 (2) effective use and allocation of resources,
2424 including faculty, staff, facilities, equipment, and financial
2525 resources, to carry out the institution's mission and purposes;
2626 (3) effective planning and budgeting to implement the
2727 institution's objectives;
2828 (4) efforts to ensure the academic quality and
2929 soundness of the activities of faculty and students;
3030 (5) clear and effective leadership consistent with the
3131 policies and decisions of the governing body of the institution;
3232 (6) understanding of the different missions and
3333 purposes among the academic divisions and programs of the
3434 institution;
3535 (7) effective recruitment and retention of capable and
3636 recognized faculty;
3737 (8) efforts to improve the quality of the
3838 institution's academic programs, including obtaining professional
3939 accreditation;
4040 (9) effective human relations skills with
4141 subordinates, alumni, the community, business and community
4242 leaders, legislators and other state and local officials, and other
4343 persons associated with the institution; and
4444 (10) excellence in public relations within the
4545 institution and with persons outside the institution.
4646 SECTION 2. Section 51.9481, Education Code, as added by
4747 this Act, applies only to an employment contract entered into or
4848 renewed by the governing board of a public institution of higher
4949 education with the chief executive officer of the institution on or
5050 after the effective date of this Act.
5151 SECTION 3. This Act takes effect September 1, 2009.
