| 7 | 7 | | relating to Tier One Challenge funding to support the development |
|---|
| 8 | 8 | | and enhancement of national research universities in this state. |
|---|
| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Chapter 61, Education Code, is amended by adding |
|---|
| 11 | 11 | | Subchapter FF to read as follows: |
|---|
| 12 | 12 | | SUBCHAPTER FF. TIER ONE CHALLENGE FUNDING |
|---|
| 13 | 13 | | Sec. 61.9771. DEFINITIONS. In this subchapter: |
|---|
| 14 | 14 | | (1) "Emerging research university" means an |
|---|
| 15 | 15 | | institution of higher education designated as an emerging research |
|---|
| 16 | 16 | | university under the board's accountability system. |
|---|
| 17 | 17 | | (2) "Research university" means an institution of |
|---|
| 18 | 18 | | higher education designated as a research university under the |
|---|
| 19 | 19 | | board's accountability system. |
|---|
| 20 | 20 | | Sec. 61.9772. PURPOSE. The purpose of this subchapter is to |
|---|
| 21 | 21 | | provide funding for the enhancement of research universities and |
|---|
| 22 | 22 | | for the development of emerging research universities. |
|---|
| 23 | 23 | | Sec. 61.9773. ELIGIBILITY FOR FUNDING. (a) Except as |
|---|
| 24 | 24 | | provided by Subsection (b), to be eligible to participate in the |
|---|
| 25 | 25 | | funding under this subchapter, a research university or emerging |
|---|
| 26 | 26 | | research university must: |
|---|
| 27 | 27 | | (1) submit to the board, in the form and manner |
|---|
| 28 | 28 | | prescribed by the board, a detailed, long-term strategic plan |
|---|
| 29 | 29 | | documenting the strategy by which the institution intends to |
|---|
| 30 | 30 | | achieve recognition as a research university, or enhance the |
|---|
| 31 | 31 | | university's reputation as a research university, as applicable; |
|---|
| 32 | 32 | | (2) receive board approval of the university's plan |
|---|
| 33 | 33 | | under Subdivision (1); and |
|---|
| 34 | 34 | | (3) meet any other criteria the board considers |
|---|
| 35 | 35 | | appropriate, including consideration of: |
|---|
| 36 | 36 | | (A) the amount of and any increase in externally |
|---|
| 37 | 37 | | generated research funds received by the university, including |
|---|
| 38 | 38 | | federal money, private gifts and donations, private endowment |
|---|
| 39 | 39 | | earnings, and funds from any local or regional source; and |
|---|
| 40 | 40 | | (B) the number of doctoral programs offered by |
|---|
| 41 | 41 | | the university and any increase in that number. |
|---|
| 42 | 42 | | (b) The University of Texas at Austin, Texas A&M University, |
|---|
| 43 | 43 | | and Prairie View A&M University are not eligible to receive funding |
|---|
| 44 | 44 | | under this subchapter. |
|---|
| 45 | 45 | | Sec. 61.9774. ALLOCATION OF FUNDING. (a) For each state |
|---|
| 46 | 46 | | fiscal year, the board shall allocate any funds appropriated for |
|---|
| 47 | 47 | | the purposes of this subchapter, and any other funds made available |
|---|
| 48 | 48 | | for the purposes of this subchapter, to research universities and |
|---|
| 49 | 49 | | emerging research universities that are eligible to participate in |
|---|
| 50 | 50 | | the funding based on an equitable formula developed by the board to |
|---|
| 51 | 51 | | further the purposes of this subchapter. |
|---|
| 52 | 52 | | (b) The board shall review the equitable formula at the end |
|---|
| 53 | 53 | | of each state fiscal biennium and may adjust the formula as the |
|---|
| 54 | 54 | | board considers appropriate. |
|---|
| 55 | 55 | | Sec. 61.9775. USE OF ALLOCATED AMOUNTS. An institution of |
|---|
| 56 | 56 | | higher education may use money received under this subchapter only |
|---|
| 57 | 57 | | for the purposes approved by the board to implement the strategic |
|---|
| 58 | 58 | | plan submitted to the board under Section 61.9773. |
|---|
| 59 | 59 | | Sec. 61.9776. ACCEPTANCE OF GIFTS OR GRANTS. The board may |
|---|
| 60 | 60 | | accept gifts or grants from any public or private source for the |
|---|
| 61 | 61 | | purposes of this subchapter. |
|---|
| 62 | 62 | | Sec. 61.9777. ANNUAL PROGRESS REPORT. (a) The board shall |
|---|
| 63 | 63 | | require each institution of higher education receiving funds under |
|---|
| 64 | 64 | | this subchapter in a state fiscal year to report to the board not |
|---|
| 65 | 65 | | later than the October 1 immediately following that state fiscal |
|---|
| 66 | 66 | | year the institution's progress toward implementing the |
|---|
| 67 | 67 | | institution's strategic plan submitted under Section 61.9773. |
|---|
| 68 | 68 | | (b) Not later than the following January 1, the board shall |
|---|
| 69 | 69 | | prepare and submit to the presiding officer of each house of the |
|---|
| 70 | 70 | | legislature a written report based on the information received by |
|---|
| 71 | 71 | | the board under Subsection (a). |
|---|
| 72 | 72 | | Sec. 61.9778. RULES. The board shall adopt rules for the |
|---|
| 73 | 73 | | administration of this subchapter. |
|---|
| 74 | 74 | | SECTION 2. The Texas Higher Education Coordinating Board |
|---|
| 75 | 75 | | shall adopt rules relating to the administration of Subchapter FF, |
|---|
| 76 | 76 | | Chapter 61, Education Code, as added by this Act, as soon as |
|---|
| 77 | 77 | | practicable after the effective date of this Act. |
|---|
| 78 | 78 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 79 | 79 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 80 | 80 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 81 | 81 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 82 | 82 | | Act takes effect September 1, 2009. |
