55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the administration of immunizations and vaccinations by
88 therapeutic optometrists.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter H, Chapter 351, Occupations Code, is
1111 amended by adding Section 351.3582 to read as follows:
1212 Sec. 351.3582. ADMINISTRATION OF IMMUNIZATIONS AND
1313 VACCINATIONS. (a) A therapeutic optometrist that satisfies the
1414 education requirements established by the board under this section
1515 may administer an immunization or vaccination to a person over the
1616 age of 14.
1717 (b) A therapeutic optometrist may not delegate the
1818 authority to administer an immunization or vaccination.
1919 (c) The board shall establish:
2020 (1) minimum education and continuing education
2121 standards for a therapeutic optometrist who administers an
2222 immunization or vaccination. The standards must include Centers
2323 for Disease Control and Prevention training, basic life support
2424 training, and hands-on training in techniques for administering
2525 immunizations and vaccinations; and
2626 (2) reporting requirements designed to notify a
2727 patient's primary care physician of any immunization or vaccination
2828 administered by a therapeutic optometrist.
2929 SECTION 2. This Act takes effect September 1, 2009.
