55 AN ACT
66 relating to the acquisition, dissemination, and use of certain
77 geographic information system data.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subsection (e), Section 16.021, Water Code, is
1010 amended to read as follows:
1111 (e) Under the guidance of the TGIC, the executive
1212 administrator shall:
1313 (1) further develop the Texas Natural Resources
1414 Information System by promoting and providing for effective
1515 acquisition, archiving, documentation, indexing, and dissemination
1616 of natural resource and related digital and nondigital data and
1717 information;
1818 (2) obtain information in response to disagreements
1919 regarding names and name spellings for natural and cultural
2020 features in the state and provide this information to the Board on
2121 Geographic Names of the United States Department of the Interior;
2222 (3) make recommendations to the Board on Geographic
2323 Names of the United States Department of the Interior for naming any
2424 natural or cultural feature subject to the limitations provided by
2525 Subsection (f);
2626 (4) make recommendations to the Department of
2727 Information Resources to adopt and promote standards that
2828 facilitate sharing of digital natural resource data and related
2929 socioeconomic data among federal, state, and local governments and
3030 other interested parties;
3131 (5) acquire and disseminate natural resource and
3232 related socioeconomic data describing the Texas-Mexico border
3333 region; [and]
3434 (6) coordinate, conduct, and facilitate the
3535 development, maintenance, and use of mutually compatible statewide
3636 digital base maps depicting natural resources and man-made
3737 features; and
3838 (7) acquire and make available to state agencies
3939 geographic information system data for areas of the United States
4040 and Mexico that are within 150 miles of the Texas border.
4141 SECTION 2. Not later than January 1, 2010, the Texas
4242 Geographic Information Council shall issue a report containing
4343 recommendations on how the state and local governmental entities
4444 may make best use of geographic information system data to respond
4545 to emergencies, including data provided by federal, state, and
4646 local governmental entities and private entities.
4747 SECTION 3. This Act does not make an appropriation. A
4848 provision in this Act that creates a new governmental program,
4949 creates a new entitlement, or imposes a new duty on a governmental
5050 entity is not mandatory during a fiscal period for which the
5151 legislature has not made a specific appropriation to implement the
5252 provision.
5353 SECTION 4. This Act takes effect immediately if it receives
5454 a vote of two-thirds of all the members elected to each house, as
5555 provided by Section 39, Article III, Texas Constitution. If this
5656 Act does not receive the vote necessary for immediate effect, this
5757 Act takes effect September 1, 2009.
