| 7 | 7 | | relating to creating a pilot project to reduce the need for |

| 8 | 8 | | developmental education required for certain students entering |
|---|
| 9 | 9 | | higher education. |
|---|
| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter L, Chapter 39, Education Code, is |
|---|
| 12 | 12 | | amended by adding Section 39.367 to read as follows: |
|---|
| 13 | 13 | | Sec. 39.367. COLLEGE READINESS PILOT PROJECT. (a) Not |
|---|
| 14 | 14 | | later than January 1, 2010, the Texas Higher Education Coordinating |
|---|
| 15 | 15 | | Board shall establish a pilot project to provide funding and |
|---|
| 16 | 16 | | support to institutions of higher education to develop programs for |
|---|
| 17 | 17 | | early intervention to prepare high school students for academic |
|---|
| 18 | 18 | | skills assessments used to determine a student's readiness to |
|---|
| 19 | 19 | | enroll in freshman-level academic course work at an institution of |
|---|
| 20 | 20 | | higher education. |
|---|
| 21 | 21 | | (b) An institution of higher education shall apply to the |
|---|
| 22 | 22 | | coordinating board to participate in the pilot project. The |
|---|
| 23 | 23 | | coordinating board shall select not more than three institutions of |
|---|
| 24 | 24 | | higher education to participate based on: |
|---|
| 25 | 25 | | (1) the merit of the institution's proposed program; |
|---|
| 26 | 26 | | (2) the number of students to be served by the program; |
|---|
| 27 | 27 | | (3) the remediation or developmental needs of the |
|---|
| 28 | 28 | | community served by the program; and |
|---|
| 29 | 29 | | (4) other criteria as determined by the coordinating |
|---|
| 30 | 30 | | board. |
|---|
| 31 | 31 | | (c) The pilot project may be funded by appropriations, by |
|---|
| 32 | 32 | | gifts, grants, and donations, and by any other funds the |
|---|
| 33 | 33 | | coordinating board obtains, including federal funds, for the pilot |
|---|
| 34 | 34 | | project. |
|---|
| 35 | 35 | | (d) Not later than January 1 of each odd-numbered year, the |
|---|
| 36 | 36 | | coordinating board shall report to the governor and to the chair of |
|---|
| 37 | 37 | | each standing committee of each house of the legislature with |
|---|
| 38 | 38 | | jurisdiction over education regarding: |
|---|
| 39 | 39 | | (1) the effectiveness of programs funded under the |
|---|
| 40 | 40 | | pilot project established by this section in minimizing the need |
|---|
| 41 | 41 | | for developmental education; and |
|---|
| 42 | 42 | | (2) recommendations regarding implementing similar |
|---|
| 43 | 43 | | programs at other institutions of higher education. |
|---|
| 44 | 44 | | (e) This section expires January 1, 2015. |
|---|
| 45 | 45 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 46 | 46 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 47 | 47 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 48 | 48 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 49 | 49 | | Act takes effect September 1, 2009. |
