66 AN ACT
77 relating to lapsed teacher certification due to a delay in agency
88 processing.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subsections (a) and (e), Section 21.0031,
1111 Education Code, are amended to read as follows:
1212 (a) An employee's probationary, continuing, or term
1313 contract under this chapter is void if the employee[:
1414 [(1)] does not hold a certificate or permit issued by the
1515 State Board for Educator Certification[; or
1616 [(2) fails to fulfill the requirements necessary to extend
1717 the employee's temporary or emergency certificate or permit].
1818 (e) This section does not apply to a certified teacher
1919 assigned to teach a subject for which the teacher is not certified
2020 or to an employee who has held a standard certificate, permit, or
2121 other type of certification under this chapter that requires
2222 renewal and who has timely fulfilled the requirements necessary for
2323 renewal, notwithstanding any delay in processing the renewal that
2424 is not within the control of the employee.
2525 SECTION 2. This Act takes effect immediately if it receives
2626 a vote of two-thirds of all the members elected to each house, as
2727 provided by Section 39, Article III, Texas Constitution. If this
2828 Act does not receive the vote necessary for immediate effect, this
2929 Act takes effect September 1, 2009.
