| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subsections (a) and (e), Section 21.0031, |
|---|
| 11 | 11 | | Education Code, are amended to read as follows: |
|---|
| 12 | 12 | | (a) An employee's probationary, continuing, or term |
|---|
| 13 | 13 | | contract under this chapter is void if the employee[: |
|---|
| 14 | 14 | | [(1)] does not hold a certificate or permit issued by the |
|---|
| 15 | 15 | | State Board for Educator Certification[; or |
|---|
| 16 | 16 | | [(2) fails to fulfill the requirements necessary to extend |
|---|
| 17 | 17 | | the employee's temporary or emergency certificate or permit]. |
|---|
| 18 | 18 | | (e) This section does not apply to a certified teacher |
|---|
| 19 | 19 | | assigned to teach a subject for which the teacher is not certified |
|---|
| 20 | 20 | | or to an employee who has held a standard certificate, permit, or |
|---|
| 21 | 21 | | other type of certification under this chapter that requires |
|---|
| 22 | 22 | | renewal and who has timely fulfilled the requirements necessary for |
|---|
| 23 | 23 | | renewal, notwithstanding any delay in processing the renewal that |
|---|
| 24 | 24 | | is not within the control of the employee. |
|---|
| 25 | 25 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 26 | 26 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 27 | 27 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 28 | 28 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 29 | 29 | | Act takes effect September 1, 2009. |
