77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Chapter 623, Transportation Code, is amended by
99 adding Subchapters O and P to read as follows:
1010 SUBCHAPTER O. PORT OF CORPUS CHRISTI AUTHORITY ROADWAY PERMITS
1111 Sec. 623.280. OPTIONAL PROCEDURE. This subchapter provides
1212 an optional procedure for the issuance of a permit by the Port of
1313 Corpus Christi Authority for the movement of oversize or overweight
1414 vehicles carrying cargo on a roadway owned and maintained by the
1515 Port of Corpus Christi Authority that is located in San Patricio
1616 County or Nueces County.
1717 Sec. 623.281. DEFINITION. In this subchapter, "port
1818 authority" means the Port of Corpus Christi Authority.
1919 Sec. 623.282. ISSUANCE OF PERMITS. The port authority may
2020 issue permits for the movement of oversize or overweight vehicles
2121 carrying cargo on a roadway owned and maintained by the port
2222 authority that is located in San Patricio County or Nueces County.
2323 A permit issued under this subchapter is in addition to other
2424 permits required by law.
2525 Sec. 623.283. PERMIT FEES. (a) The port authority may
2626 collect a fee for permits issued under this subchapter. The fees
2727 may not exceed $80 per trip.
2828 (b) Fees collected under Subsection (a) shall be used solely
2929 for the construction and maintenance of port authority roadways.
3030 Sec. 623.284. PERMIT REQUIREMENTS. A permit issued under
3131 this subchapter must include:
3232 (1) the name of the applicant;
3333 (2) the date of issuance;
3434 (3) the signature of the manager of transportation of
3535 the port authority;
3636 (4) a statement of the kind of cargo being
3737 transported, the maximum weight and dimensions of the equipment,
3838 and the kind and weight of each commodity to be transported;
3939 (5) a statement of any condition on which the permit is
4040 issued;
4141 (6) a statement that the cargo may only be transported
4242 on roadways that are owned and maintained by the port authority and
4343 located in San Patricio County or Nueces County; and
4444 (7) the location where the cargo was loaded.
4545 Sec. 623.285. TIME OF MOVEMENT. A permit issued under this
4646 subchapter must specify the time in which movement authorized by
4747 the permit is allowed.
4848 Sec. 623.286. SPEED LIMIT. Movement authorized by a permit
4949 issued under this subchapter may not exceed the posted speed limit
5050 or 55 miles per hour, whichever is less. Violation of this
5151 provision shall constitute a moving violation.
5252 Sec. 623.287. ENFORCEMENT. The Department of Public Safety
5353 shall have authority to enforce the provisions of this subchapter.
5454 Sec. 623.288. RULES. The Texas Transportation Commission
5555 may adopt rules necessary to implement this subchapter.
5656 SUBCHAPTER P. PORT OF CORPUS CHRISTI AUTHORITY SPECIAL FREIGHT
5757 CORRIDOR PERMITS
5858 Sec. 623.301. OPTIONAL PROCEDURE. This subchapter provides
5959 an optional procedure for the issuance of a permit by the Port of
6060 Corpus Christi Authority for the movement of oversize or overweight
6161 vehicles carrying cargo on a state highway special freight corridor
6262 located in San Patricio County.
6363 Sec. 623.302. DEFINITIONS. In this subchapter:
6464 (1) "Port authority" means the Port of Corpus Christi
6565 Authority; and
6666 (2) "Special freight corridor" means a highway built
6767 by this state specifically for the movement of oversize or
6868 overweight vehicles carrying cargo in San Patricio County to and
6969 from the port authority's La Quinta terminal.
7070 Sec. 623.303. ISSUANCE OF PERMITS. The Texas
7171 Transportation Commission may authorize the port authority to issue
7272 permits for the movement of oversize or overweight vehicles
7373 carrying cargo on state highway special freight corridors located
7474 in San Patricio County. The port authority may issue a permit under
7575 this subchapter only if the cargo being transported weighs 125,000
7676 pounds or less.
7777 Sec. 623.304. MAINTENANCE CONTRACTS. The port authority
7878 shall make payments to the department to provide funds for the
7979 maintenance of state highways subject to this subchapter.
8080 Sec. 623.305. PERMIT FEES. (a) The port authority may
8181 collect a fee for permits issued under this subchapter. The fees
8282 may not exceed $80 per trip.
8383 (b) Fees collected under Subsection (a) shall be used solely
8484 to provide funds for the payments provided for under Section
8585 623.304 and for the port authority's administrative costs, which
8686 may not exceed 15 percent of the fees collected. The fees shall be
8787 deposited in the state highway fund. Fees deposited in the state
8888 highway fund under this section are exempt from the application of
8989 Section 403.095, Government Code.
9090 Sec. 623.306. PERMIT REQUIREMENTS. (a) A permit issued
9191 under this subchapter must include:
9292 (1) the name of the applicant;
9393 (2) the date of issuance;
9494 (3) the signature of the manager of transportation of
9595 the port authority;
9696 (4) a statement of the kind of cargo being
9797 transported, the maximum weight and dimensions of the equipment,
9898 and the kind and weight of each commodity to be transported;
9999 (5) a statement of any condition on which the permit is
100100 issued;
101101 (6) a statement that the cargo may only be transported
102102 to and from the port authority's La Quinta terminal in San Patricio
103103 County using a state highway special freight corridor in San
104104 Patricio County; and
105105 (7) the location where the cargo was loaded.
106106 (b) The port authority shall report to the department all
107107 permits issued under this subchapter.
108108 Sec. 623.307. TIME OF MOVEMENT. A permit issued under this
109109 subchapter must specify the time in which movement authorized by
110110 the permit is allowed.
