| 6 | 6 | | counties prepare a written records management and preservation |
|---|
| 7 | 7 | | services plan. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Subsection (e), Section 118.0216, Local |
|---|
| 10 | 10 | | Government Code, is amended to read as follows: |
|---|
| 11 | 11 | | (e) [In a county that is adjacent to an international |
|---|
| 12 | 12 | | boundary, the county clerk shall prepare an annual written plan for |
|---|
| 13 | 13 | | funding the automation projects and records management and |
|---|
| 14 | 14 | | preservation services performed by the clerk. After a public |
|---|
| 15 | 15 | | hearing, the plan shall be considered for approval by the |
|---|
| 16 | 16 | | commissioners court. Funds from the records management and |
|---|
| 17 | 17 | | preservation account may be expended only as provided by the plan.] |
|---|
| 18 | 18 | | All expenditures from the records management and preservation |
|---|
| 19 | 19 | | account shall comply with Subchapter C, Chapter 262. |
|---|
| 20 | 20 | | SECTION 2. The change in law made by this Act to Subsection |
|---|
| 21 | 21 | | (e), Section 118.0216, Local Government Code, applies only to a |
|---|
| 22 | 22 | | requirement that a county clerk prepare an annual written plan on or |
|---|
| 23 | 23 | | after the effective date of this Act. A plan adopted before the |
|---|
| 24 | 24 | | effective date of this Act and expenditures under that plan are |
|---|
| 25 | 25 | | subject to the requirements of Subsection (e), Section 118.0216, |
|---|
| 26 | 26 | | Local Government Code, as that law existed on the date the plan was |
|---|
| 27 | 27 | | adopted, and the former law is continued in effect for that purpose. |
|---|
| 28 | 28 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 29 | 29 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 30 | 30 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 31 | 31 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 32 | 32 | | Act takes effect September 1, 2009. |
