55 relating to the random assignment of criminal and civil cases in
66 district courts in Hidalgo County.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Subchapter A, Chapter 24, Government Code, is
99 amended by adding Section 24.034 to read as follows:
1010 Sec. 24.034. ASSIGNMENT OF CASES IN DISTRICT COURTS IN
1111 HIDALGO COUNTY. (a) All civil and criminal cases in the district
1212 courts in Hidalgo County shall be assigned and docketed at random by
1313 the district clerk using an automated system.
1414 (b) In assigning a case to a district court, the district
1515 clerk shall take into consideration any requirement in Subchapter B
1616 that a district court in Hidalgo County give preference to specific
1717 matters.
1818 SECTION 2. The following provisions of the Government Code
1919 are repealed:
2020 (1) Subsection (d), Section 24.194;
2121 (2) Subsection (d), Section 24.195;
2222 (3) Subsection (d), Section 24.241;
2323 (4) Subsection (b), Section 24.385;
2424 (5) Subsection (b), Section 24.452;
2525 (6) Subsection (b), Section 24.478;
2626 (7) Subsection (b), Section 24.515;
2727 (8) Subsection (c), Section 24.534;
2828 (9) Subsection (c), Section 24.543; and
2929 (10) Subsection (c), Section 24.574.
3030 SECTION 3. The change in law made by this Act applies only
3131 to a case assigned to a Hidalgo County district court on or after
3232 the effective date of this Act.
3333 SECTION 4. This Act takes effect September 1, 2009.
