77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Subchapter C, Chapter 29, Education Code, is
99 amended by adding Section 29.092 to read as follows:
1010 Sec. 29.092. ALGEBRA INSTRUCTION GRANT PROGRAM. (a) From
1111 funds appropriated for that purpose, the commissioner shall
1212 establish a program under which grants are awarded to school
1313 districts to implement an algebra instruction program. From the
1414 funds appropriated for use under Section 28.0211, the commissioner
1515 may use not more than $50 million for the grant program provided by
1616 this section.
1717 (b) The commissioner shall develop a comprehensive
1818 intervention plan to assist school districts with a
1919 disproportionate number of students who fail to perform
2020 satisfactorily on the assessment instrument administered under
2121 Section 39.023(a)(1) in grades five through seven. The plan must be
2222 based on high-quality research.
2323 (c) The commissioner shall establish application criteria
2424 for receiving a grant under this section. The criteria must require
2525 a school district that applies for a grant to submit a local
2626 intervention plan that meets the standards adopted by the
2727 commissioner. In awarding grants under this section, the
2828 commissioner shall give preference to districts with the lowest
2929 rate of satisfactory performance on assessment instruments
3030 administered under Section 39.023(a)(1) in grades five through
3131 seven.
3232 (d) A grant under this section must:
3333 (1) support sustained improvement in the school
3434 district's pre-algebra mathematics instruction in grades five
3535 through eight; and
3636 (2) target students who will be administered the
3737 Algebra I end-of-course assessment instrument beginning in the
3838 2011-2012 school year.
3939 (e) A grant awarded under this section may be used for
4040 providing:
4141 (1) training and payment of state intervention coaches
4242 to assist school districts in implementing the grant;
4343 (2) training and instructional materials in
4444 pre-algebra skills in grades five through eight;
4545 (3) professional development of mathematics teachers
4646 assigned to grades five through eight;
4747 (4) flexibility in the school day for instruction;
4848 (5) instructional services; and
4949 (6) technology as part of instructional activities.
5050 (f) The commissioner may condition a grant on the
5151 implementation of the comprehensive intervention plan and may
5252 withhold or recover any funds not spent as provided by the plan
5353 approved under Subsection (b). A decision of the commissioner
5454 under this subsection is final and may not be appealed.
5555 (g) The commissioner may require a school district to make
5656 financial and other commitments as part of a grant application.
5757 (h) The commissioner shall:
5858 (1) establish guidelines for implementing the grant
5959 program; and
6060 (2) adopt rules necessary to administer the grant
6161 program.
6262 SECTION 2. This Act does not make an appropriation. This
6363 Act takes effect only if a specific appropriation for the
6464 implementation of the Act is provided in a general appropriations
6565 act of the 81st Legislature.
6666 SECTION 3. Except as otherwise provided by this Act, this
6767 Act takes effect immediately if it receives a vote of two-thirds of
6868 all the members elected to each house, as provided by Section 39,
6969 Article III, Texas Constitution. If this Act does not receive the
7070 vote necessary for immediate effect, this Act takes effect
7171 September 1, 2009, except as otherwise provided by this Act.
