77 relating to the criminal penalty for capturing, transporting, or
88 transplanting white-tailed or mule deer without a permit.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 43.062, Parks and Wildlife Code, is
1111 amended to read as follows:
1212 Sec. 43.062. PENALTIES [PENALTY]. (a) Except as provided
1313 by Subsection (b), a [A] person who violates any provision of this
1414 subchapter or the terms of a permit issued under this subchapter
1515 commits an offense that is a Class B Parks and Wildlife Code
1616 misdemeanor.
1717 (b) A person who violates Section 43.061(a) by
1818 intentionally capturing, transporting, or transplanting a
1919 white-tailed or mule deer without obtaining the required permit or
2020 by intentionally violating one or more terms of the permit commits
2121 an offense that is a Parks and Wildlife Code state jail felony.
2222 SECTION 2. The changes in the law made by this Act apply
2323 only to an offense committed on or after the effective date of this
2424 Act. For purposes of this section, an offense is committed before
2525 the effective date of this Act if any element of the offense occurs
2626 before that date. An offense committed before the effective date of
2727 this Act is covered by the law in effect when the offense was
2828 committed, and the former law is continued in effect for that
2929 purpose.
3030 SECTION 3. This Act takes effect September 1, 2009.
