| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Subchapter L, Chapter 43, Parks and Wildlife | |
| 11 | 11 | Code, is amended by adding Section 43.3665 to read as follows: | |
| 12 | 12 | Sec. 43.3665. GUIDELINES. The commission shall adopt and | |
| 13 | 13 | periodically update guidelines to be used in determining the | |
| 14 | 14 | penalty for a violation of this subchapter or a regulation adopted | |
| 15 | 15 | under this subchapter, including: | |
| 16 | 16 | (1) a review of the penalties typically imposed at the | |
| 17 | 17 | time the guidelines are adopted or updated; and | |
| 18 | 18 | (2) a penalty matrix that specifies: | |
| 19 | 19 | (A) the penalty the commission considers | |
| 20 | 20 | appropriate for certain violations; and | |
| 21 | 21 | (B) the circumstances justifying the revocation | |
| 22 | 22 | of a permit issued under this subchapter. | |
| 23 | 23 | SECTION 2. The Parks and Wildlife Commission shall adopt | |
| 24 | 24 | the guidelines required by Section 43.3665, Parks and Wildlife | |
| 25 | 25 | Code, as added by this Act, not later than March 1, 2010. | |
| 26 | 26 | SECTION 3. This Act takes effect September 1, 2009. |
