55 relating to specialty license plates supporting the Safe Routes to
66 School Program.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 504.648, Transportation Code, is amended
99 by amending Subsection (b) and adding Subsections (d) and (e) to
1010 read as follows:
1111 (b) After deduction of the department's administrative
1212 costs, the remainder of the fee [for issuance of the license plates]
1313 shall be deposited to the credit of the share the road account in
1414 the state treasury [state highway fund] and may only be used by the
1515 Texas Education Agency to support [for] the Safe Routes to School
1616 Program of a designated statewide nonprofit organization whose
1717 primary purpose is to promote bicyclist safety, education, and
1818 access through:
1919 (1) education and awareness programs; and
2020 (2) training, workshops, educational materials, and
2121 media events.
2222 (d) Up to 25 percent of the amount in Subsection (b) may be
2323 used to support the activities of the nonprofit organization in
2424 marketing and promoting the Safe Routes to School Program and the
2525 God Bless Texas and God Bless America license plates.
2626 (e) The Texas Education Agency may use money received under
2727 this section to secure funds available under federal matching
2828 programs for safe routes to school and obesity prevention.
2929 SECTION 2. This Act takes effect immediately if it receives
3030 a vote of two-thirds of all the members elected to each house, as
3131 provided by Section 39, Article III, Texas Constitution. If this
3232 Act does not receive the vote necessary for immediate effect, this
3333 Act takes effect September 1, 2009.
