5	5	relating to the titling and registration of certain motor vehicles.
6	6	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
7	7	SECTION 1. Section 501.021, Transportation Code, is amended
8	8	by adding Subsection (c) to read as follows:
9	9	(c) A certificate of title for a motor vehicle that has been
10	10	the subject of an ordered repurchase or replacement under Chapter
11	11	2301, Occupations Code, must contain on its face a notice
12	12	sufficient to inform a purchaser that the motor vehicle has been the
13	13	subject of an ordered repurchase or replacement.
14	14	SECTION 2. Section 520.023, Transportation Code, is amended
15	15	by adding Subsection (g) to read as follows:
16	16	(g) A transferor who files the appropriate form with the
17	17	department as provided by, and in accordance with, this section,
18	18	whether that form is a part of a certificate of title or a form
19	19	otherwise promulgated by the department to comply with the terms of
20	20	this section, has no vicarious civil or criminal liability arising
21	21	out of the use, operation, or abandonment of the vehicle by another
22	22	person. Proof by the transferor that the transferor filed a form
23	23	under this section is a complete defense to an action brought
24	24	against the transferor for an act or omission, civil or criminal,
25	25	arising out of the use, operation, or abandonment of the vehicle by
26	26	another person after the transferor filed the form. A copy of the
27	27	form filed under this section is proof of the filing of the form.
28	28	SECTION 3. Section 702.003, Transportation Code, is amended
29	29	by adding Subsection (f) to read as follows:
30	30	(f) This section does not apply to the registration of a
31	31	motor vehicle under Section 501.0234.
32	32	SECTION 4. Section 707.017, Transportation Code, is amended
33	33	to read as follows:
34	34	Sec. 707.017. ENFORCEMENT. If the owner of a motor vehicle
35	35	is delinquent in the payment of a civil penalty imposed under this
36	36	chapter, the county assessor-collector or the Texas Department of
37	37	Transportation may refuse to register a motor vehicle alleged to
38	38	have been involved in the violation. This section does not apply to
39	39	the registration of a motor vehicle under Section 501.0234.
40	40	SECTION 5. (a) The change in law made to Section 501.021,
41	41	Transportation Code, as amended by this Act, applies only to a title
42	42	issued on or after the effective date of this Act. A title issued
43	43	before the effective date of this Act is governed by the law in
44	44	effect immediately before the effective date of this Act, and the
45	45	former law is continued in effect for that purpose.
46	46	(b) The change in law made to Section 520.023,
47	47	Transportation Code, as amended by this Act, applies only to a
48	48	transfer of a vehicle that occurred on or after the effective date
49	49	of this Act. A transfer that occurred before the effective date of
50	50	this Act is governed by the law in effect immediately before the
51	51	effective date of this Act, and the former law is continued in
52	52	effect for that purpose.
53	53	(c) The change in law made to Sections 702.003 and 707.017,
54	54	Transportation Code, as amended by this Act, applies only to a
55	55	registration period beginning on or after the effective date of
56	56	this Act.
57	57	SECTION 6. This Act takes effect September 1, 2009.
