| 8 | 8 | | securities by a home-rule municipality. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 1201.028, Government Code, is amended to |
|---|
| 11 | 11 | | read as follows: |
|---|
| 12 | 12 | | Sec. 1201.028. SINGLE MEETING OF GOVERNING BODY SUFFICIENT. |
|---|
| 13 | 13 | | Notwithstanding any other law, including a provision in a municipal |
|---|
| 14 | 14 | | charter, the following actions taken at a meeting of the governing |
|---|
| 15 | 15 | | body of an issuer are effective immediately, without requirement of |
|---|
| 16 | 16 | | [and] a subsequent meeting, and are not subject to challenge by |
|---|
| 17 | 17 | | referendum [is not required]: |
|---|
| 18 | 18 | | (1) a resolution, order, or ordinance calling an |
|---|
| 19 | 19 | | election to: |
|---|
| 20 | 20 | | (A) authorize the issuance and sale of a public |
|---|
| 21 | 21 | | security; or |
|---|
| 22 | 22 | | (B) approve the resources, revenue, or income of |
|---|
| 23 | 23 | | the issuer that may be pledged as security for a public security; |
|---|
| 24 | 24 | | (2) a resolution, order, or ordinance canvassing the |
|---|
| 25 | 25 | | results of an election described by Subdivision (1); or |
|---|
| 26 | 26 | | (3) a public security authorization. |
|---|
| 27 | 27 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 28 | 28 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 29 | 29 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 30 | 30 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 31 | 31 | | Act takes effect September 1, 2009. |
