55 AN ACT
66 relating to the applicability of certain municipal home-rule
77 charter provisions on actions relating to the issuance of public
88 securities by a home-rule municipality.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 1201.028, Government Code, is amended to
1111 read as follows:
1212 Sec. 1201.028. SINGLE MEETING OF GOVERNING BODY SUFFICIENT.
1313 Notwithstanding any other law, including a provision in a municipal
1414 charter, the following actions taken at a meeting of the governing
1515 body of an issuer are effective immediately, without requirement of
1616 [and] a subsequent meeting, and are not subject to challenge by
1717 referendum [is not required]:
1818 (1) a resolution, order, or ordinance calling an
1919 election to:
2020 (A) authorize the issuance and sale of a public
2121 security; or
2222 (B) approve the resources, revenue, or income of
2323 the issuer that may be pledged as security for a public security;
2424 (2) a resolution, order, or ordinance canvassing the
2525 results of an election described by Subdivision (1); or
2626 (3) a public security authorization.
2727 SECTION 2. This Act takes effect immediately if it receives
2828 a vote of two-thirds of all the members elected to each house, as
2929 provided by Section 39, Article III, Texas Constitution. If this
3030 Act does not receive the vote necessary for immediate effect, this
3131 Act takes effect September 1, 2009.
