66 AN ACT
77 relating to the regulation of off-premises signs in the
88 unincorporated area of a county.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter Z, Chapter 240, Local Government
1111 Code, is amended by adding Section 240.908 to read as follows:
1212 Sec. 240.908. REGULATION OF OFF-PREMISES SIGNS. (a) In
1313 this section, "sign" and "off-premises sign" have the meanings
1414 assigned by Section 216.002.
1515 (b) Notwithstanding any other law, the commissioners court
1616 of a county by order may prohibit the erection of off-premises signs
1717 along roads in the unincorporated area of the county. The
1818 commissioners court may not require the relocation,
1919 reconstruction, or removal of an off-premises sign in existence on
2020 the effective date of this section.
2121 (c) Before the commissioners court of a county may issue an
2222 order under Subsection (b), the commissioners court shall hold a
2323 public hearing on the proposed order. Before the 15th day before
2424 the date of the hearing, the commissioners court must publish
2525 notice of the hearing in a newspaper of general circulation in the
2626 county.
2727 SECTION 2. This Act takes effect immediately if it receives
2828 a vote of two-thirds of all the members elected to each house, as
2929 provided by Section 39, Article III, Texas Constitution. If this
3030 Act does not receive the vote necessary for immediate effect, this
3131 Act takes effect September 1, 2009.
