99 AN ACT
1010 relating to the election and terms of office of directors of the
1111 Guadalupe County Groundwater Conservation District.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 9, Chapter 1066, Acts of the 75th
1414 Legislature, Regular Session, 1997, is amended to read as follows:
1515 Sec. 9. ELECTION OF DIRECTORS. [(a)] On the uniform
1616 election date in November of each odd-numbered year, the district
1717 shall hold an election in the district to elect [first Saturday in
1818 May of the second year after the year in which the district is
1919 authorized to be created at a confirmation election, an election
2020 shall be held in the district for the election of three directors,
2121 each of whom shall serve a two-year term, and four directors, each
2222 of whom shall serve a four-year term.
2323 [(b) On the first Saturday in May of each subsequent second
2424 year following the election,] the appropriate number of directors
2525 [shall be elected] to the district's board of directors.
2626 SECTION 2. Subsection (g), Section 6, Chapter 1066, Acts of
2727 the 75th Legislature, Regular Session, 1997, is repealed.
2828 SECTION 3. (a) All governmental acts and proceedings of
2929 the Guadalupe County Groundwater Conservation District relating to
3030 the election of members of the board of directors of the district
3131 that were taken before the effective date of this Act are validated,
3232 ratified, and confirmed in all respects as if they had been taken as
3333 authorized by law.
3434 (b) This section does not apply to any matter that on the
3535 effective date of this Act:
3636 (1) is involved in litigation if the litigation
3737 ultimately results in the matter being held invalid by a final court
3838 judgment; or
3939 (2) has been held invalid by a final court judgment.
4040 SECTION 4. (a) The legal notice of the intention to
4141 introduce this Act, setting forth the general substance of this
4242 Act, has been published as provided by law, and the notice and a
4343 copy of this Act have been furnished to all persons, agencies,
4444 officials, or entities to which they are required to be furnished
4545 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
4646 Government Code.
4747 (b) The governor, one of the required recipients, has
4848 submitted the notice and Act to the Texas Commission on
4949 Environmental Quality.
5050 (c) The Texas Commission on Environmental Quality has filed
5151 its recommendations relating to this Act with the governor, the
5252 lieutenant governor, and the speaker of the house of
5353 representatives within the required time.
5454 (d) All requirements of the constitution and laws of this
5555 state and the rules and procedures of the legislature with respect
5656 to the notice, introduction, and passage of this Act are fulfilled
5757 and accomplished.
5858 SECTION 5. This Act takes effect immediately if it receives
5959 a vote of two-thirds of all the members elected to each house, as
6060 provided by Section 39, Article III, Texas Constitution. If this
6161 Act does not receive the vote necessary for immediate effect, this
6262 Act takes effect September 1, 2009.
