9	9	AN ACT
10	10	relating to the election and terms of office of directors of the
11	11	Guadalupe County Groundwater Conservation District.
12	12	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
13	13	SECTION 1. Section 9, Chapter 1066, Acts of the 75th
14	14	Legislature, Regular Session, 1997, is amended to read as follows:
15	15	Sec. 9. ELECTION OF DIRECTORS. [(a)] On the uniform
16	16	election date in November of each odd-numbered year, the district
17	17	shall hold an election in the district to elect [first Saturday in
18	18	May of the second year after the year in which the district is
19	19	authorized to be created at a confirmation election, an election
20	20	shall be held in the district for the election of three directors,
21	21	each of whom shall serve a two-year term, and four directors, each
22	22	of whom shall serve a four-year term.
23	23	[(b) On the first Saturday in May of each subsequent second
24	24	year following the election,] the appropriate number of directors
25	25	[shall be elected] to the district's board of directors.
26	26	SECTION 2. Subsection (g), Section 6, Chapter 1066, Acts of
27	27	the 75th Legislature, Regular Session, 1997, is repealed.
28	28	SECTION 3. (a) All governmental acts and proceedings of
29	29	the Guadalupe County Groundwater Conservation District relating to
30	30	the election of members of the board of directors of the district
31	31	that were taken before the effective date of this Act are validated,
32	32	ratified, and confirmed in all respects as if they had been taken as
33	33	authorized by law.
34	34	(b) This section does not apply to any matter that on the
35	35	effective date of this Act:
36	36	(1) is involved in litigation if the litigation
37	37	ultimately results in the matter being held invalid by a final court
38	38	judgment; or
39	39	(2) has been held invalid by a final court judgment.
40	40	SECTION 4. (a) The legal notice of the intention to
41	41	introduce this Act, setting forth the general substance of this
42	42	Act, has been published as provided by law, and the notice and a
43	43	copy of this Act have been furnished to all persons, agencies,
44	44	officials, or entities to which they are required to be furnished
45	45	under Section 59, Article XVI, Texas Constitution, and Chapter 313,
46	46	Government Code.
47	47	(b) The governor, one of the required recipients, has
48	48	submitted the notice and Act to the Texas Commission on
49	49	Environmental Quality.
50	50	(c) The Texas Commission on Environmental Quality has filed
51	51	its recommendations relating to this Act with the governor, the
52	52	lieutenant governor, and the speaker of the house of
53	53	representatives within the required time.
54	54	(d) All requirements of the constitution and laws of this
55	55	state and the rules and procedures of the legislature with respect
56	56	to the notice, introduction, and passage of this Act are fulfilled
57	57	and accomplished.
58	58	SECTION 5. This Act takes effect immediately if it receives
59	59	a vote of two-thirds of all the members elected to each house, as
60	60	provided by Section 39, Article III, Texas Constitution. If this
61	61	Act does not receive the vote necessary for immediate effect, this
62	62	Act takes effect September 1, 2009.
