55 relating to the powers of a recreation district board in a county

77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 324.099, Local Government Code, is
99 amended by adding Subsections (l) and (m) to read as follows:
1010 (l) The managing entity, as defined by Section 221.002,
1111 Property Code, of a timeshare property, as defined by Section
1212 221.002, Property Code, shall collect and remit to a district, on a
1313 property owner's behalf, all district taxes imposed under
1414 Subsection (b)(2) if the managing entity participates in the rental
1515 of the property by either:
1616 (1) advertising rental availability on behalf of the
1717 property owner; or
1818 (2) collecting the rent on the property owner's
1919 behalf.
2020 (m) If a managing entity located in the district does not
2121 collect rent or advertise rental availability on behalf of its
2222 property owners, a certificate executed in good faith by the
2323 managing entity and delivered to the district informing the
2424 district that the managing entity does not collect rent or
2525 advertise rentals on the behalf of property owners shall be final
2626 and binding on the district, so long as the certificate remains
2727 accurate.
2828 SECTION 2. Subchapter E, Chapter 324, Local Government
2929 Code, is amended by adding Section 324.0995 to read as follows:
3030 Sec. 324.0995. TAX EXEMPTIONS. (a) Section 324.099(b)(2)
3131 does not impose a tax on:
3232 (1) an employee of the United States government
3333 conducting official business in the district; or
3434 (2) a person who occupies a lodging facility or
3535 campground in the district if the person has evacuated from the
3636 person's home due to an emergency and the state has temporarily
3737 suspended collection of the state hotel occupancy tax.
3838 (b) The district may not tax a transaction between a person
3939 and an interest operated by:
4040 (1) the United States in the district; or
4141 (2) a state park in the district.
4242 SECTION 3. Section 324.122, Local Government Code, is
4343 amended to read as follows:
4444 Sec. 324.122. EFFECT OF INCORPORATION OR ANNEXATION. The
4545 incorporation of a political subdivision or the annexation of any
4646 part of [any area in] a park district by a political subdivision
4747 does not affect the district's boundaries.
4848 SECTION 4. The change in law made by this Act does not
4949 affect tax liability accruing before the effective date of this
5050 Act. That liability continues in effect as if this Act had not been
5151 enacted, and the former law is continued in effect for the
5252 collection of taxes due and for civil and criminal enforcement of
5353 the liability for those taxes.
5454 SECTION 5. This Act takes effect September 1, 2009.
