44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the availability on the Internet of certain information
77 regarding the child protective services functions of the Department
88 of Family and Protective Services.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 40, Human Resources Code,
1111 is amended by adding Section 40.03052 to read as follows:
1212 Sec. 40.03052. PUBLIC ACCESS TO CERTAIN DEPARTMENT DATA.
1313 (a) The commissioner shall make available to the public,
1414 through the department's Internet website, certain statistical
1515 information maintained by the department and of interest to the
1616 public regarding the child protective services program
1717 administered by the department. The department shall consult with
1818 interested stakeholders in determining the data elements to be
1919 published that shall include but not be limited to:
2020 (1) the number and percentage of children who the
2121 department is aware:
2222 (i) are placed with relatives by a parent as
2323 a result of:
2424 (a) an investigation; or
2525 (b) the parent's participation in
2626 family-based safety services when:
2727 (1) this placement is included
2828 in the family's safety plan;
2929 (2) the department does a
3030 background check on the relative with whom the child is to be
3131 placed; or
3232 (3) the department seeks a court
3333 order to require the parent to participate in family based safety
3434 services.
3535 (ii) are returned to foster care from a
3636 relative placement due to the relative's financial hardship.
3737 (b) The department shall modify current policies to ensure
3838 that the data is collected in the least burdensome manner possible
3939 that does not compromise the integrity and relevancy of the data.
4040 (c) The system developed under this section must:
4141 (1) provide information in a summarized format easily
4242 understood by the public;
4343 (2) allow users to search, sort, and download the
4444 information.
4545 (d) The information published on the department's Internet
4646 website as provided by this section must:
4747 (1) be updated at least quarterly;
4848 (2) be organized appropriately based on subject matter
4949 and easily accessible from a clearly identified location on the
5050 Internet website;
5151 (3) include data aggregated at both the statewide and
5252 administrative region levels.
5353 (e) The department shall make the information maintained
5454 under this section available, other than information that is
5555 required by law to be confidential.
5656 SECTION 2. This Act takes effect September 1, 2009 for
5757 department data included on the website as of that date.
